  1.1                          A bill for an act 
  1.2             relating to crime prevention; requiring the 
  1.3             commissioner of corrections to develop and report on a 
  1.4             plan to increase state correctional capacity. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [PLAN TO INCREASE STATE CORRECTIONAL CAPACITY.] 
  1.7      (a) The commissioner of corrections shall report to the 
  1.8   legislature on ways to incarcerate inmates projected to be 
  1.9   committed to the commissioner's custody when the number of those 
  1.10  inmates are in excess of the department's current capacity. 
  1.11     (b) The report must address the feasibility and 
  1.12  advisability of expanding current correctional facilities to 
  1.13  meet the need for expanded capacity and include a plan to do so. 
  1.14     (c) In addition, the report must address the advisability 
  1.15  of constructing a new correctional facility as a means of 
  1.16  meeting the department's capacity needs.  If the commissioner 
  1.17  determines that it is advisable to construct a new correctional 
  1.18  facility, the commissioner shall convene the correctional 
  1.19  facility site selection committee established under Minnesota 
  1.20  Statutes, section 243.93, to make recommendations on the siting 
  1.21  of this new facility and include these recommendations and a 
  1.22  plan for constructing the facility in the report. 
  1.23     (d) By January 15, 2004, the commissioner shall submit the 
  1.24  report required under this section to the chairs and ranking 
  1.25  minority members of the senate and house of representatives 
  2.1   committees and divisions having jurisdiction over correctional 
  2.2   policy and funding.  
  2.3      Sec. 2.  [EFFECTIVE DATE.] 
  2.4      Section 1 is effective the day following final enactment.
