  1.1                          A bill for an act 
  1.2             relating to peace officers; authorizing deadly force 
  1.3             policies that prohibit deadly force justified under 
  1.4             state law; amending Minnesota Statutes 1994, section 
  1.5             626.8452, subdivision 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 626.8452, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [DEADLY FORCE POLICY.] By January 1, 1992, 
  1.10  the head of every local and state law enforcement agency shall 
  1.11  establish and enforce a written policy governing the use of 
  1.12  force, including deadly force, as defined in section 609.066, by 
  1.13  peace officers and part-time peace officers employed by the 
  1.14  agency.  The policy must be consistent with the provisions of 
  1.15  section 609.066, subdivision 2, and may not but may prohibit the 
  1.16  use of deadly force under circumstances in which that force is 
  1.17  justified under section 609.066, subdivision 2. 
  1.18     Sec. 2.  [EFFECTIVE DATE.] 
  1.19     This act is effective the day following final enactment.
