  1.1                          A bill for an act 
  1.2             proposing an amendment to the Minnesota Constitution, 
  1.3             article VII, section 1; allowing recreational property 
  1.4             owners to vote on bonding and property tax questions 
  1.5             where the recreational property is located; providing 
  1.6             implementing language; proposing coding for new law in 
  1.7             Minnesota Statutes, chapter 204B. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [CONSTITUTIONAL AMENDMENT PROPOSED.] 
  1.10     Subdivision 1.  The following amendment to the Minnesota 
  1.11  Constitution, article VII, section 1, is proposed to the people. 
  1.12  If the amendment is adopted, the section shall read as follows: 
  1.13     Section 1.  Every person 18 years of age or more who has 
  1.14  been a citizen of the United States for three months and who has 
  1.15  resided in the precinct for 30 days next preceding an election 
  1.16  shall be entitled to vote in that precinct.  In addition, every 
  1.17  person 18 years of age or more, who has been a citizen of the 
  1.18  United States for three months, and who owns noncommercial, 
  1.19  temporary and seasonal residential recreational property may 
  1.20  vote in the precinct where the property is located on any 
  1.21  question concerning property taxes or issuance of bonds.  The 
  1.22  place of voting by one otherwise qualified who has changed his 
  1.23  residence within 30 days preceding the election shall be 
  1.24  prescribed by law.  The following persons shall not be entitled 
  1.25  or permitted to vote at any election in this state:  A person 
  1.26  not meeting the above requirements; a person who has been 
  2.1   convicted of treason or felony, unless restored to civil rights; 
  2.2   a person under guardianship, or a person who is insane or not 
  2.3   mentally competent. 
  2.4      Sec. 2.  [SUBMISSION TO VOTERS.] 
  2.5      The proposed amendment shall be submitted to the people at 
  2.6   the 1996 general election.  The question submitted shall be: 
  2.7      "Shall the Minnesota Constitution be amended to allow 
  2.8   recreational property owners to vote on property taxes and 
  2.9   issuance of bonds where the recreational property is located? 
  2.10                                     Yes .......
  2.11                                     No ........"
  2.12     Sec. 3.  [204B.47] [CERTAIN PROPERTY TAX AND BOND 
  2.13  QUESTIONS; SECRETARY OF STATE RULES.] 
  2.14     The owners of noncommercial, temporary and seasonal 
  2.15  residential recreational property may vote in the precinct where 
  2.16  the property is located on any question concerning property 
  2.17  taxes or issuance of bonds.  Owners may register to vote in the 
  2.18  precinct, for purposes of such questions only, under procedures 
  2.19  developed by the secretary of state by rule.  Owners may vote by 
  2.20  absentee ballot in the manner provided by chapter 203B or may 
  2.21  vote in a mail election as provided in section 204B.45. 
  2.22     Sec. 4.  [EFFECTIVE DATE.] 
  2.23     Section 3 is effective upon ratification of the amendment 
  2.24  proposed in section 1.
