  1.1                          A bill for an act 
  1.2             relating to education; providing for school board 
  1.3             contracting; amending Minnesota Statutes 1996, 
  1.4             sections 123.35, by adding subdivisions; and 126.22, 
  1.5             subdivisions 3 and 3a. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 123.35, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 1a.  [CONTRACTS FOR SERVICES.] Notwithstanding any 
  1.10  law to the contrary, a school board may contract with a public 
  1.11  or private entity to provide instructional and noninstructional 
  1.12  services.  The board may reduce its administration accordingly.  
  1.13  The board shall not enter into an agreement restricting the 
  1.14  powers provided in this subdivision.  
  1.15     Sec. 2.  Minnesota Statutes 1996, section 123.35, is 
  1.16  amended by adding a subdivision to read: 
  1.17     Subd. 1b.  [REORGANIZATION AS A NONPROFIT ENTITY.] A school 
  1.18  board may reorganize its school district administration under 
  1.19  chapter 317A.  The board and the reorganized administration 
  1.20  shall contract for the administration to provide instructional 
  1.21  and noninstructional services.  The board shall not enter any 
  1.22  agreement restricting the powers provided in this subdivision. 
  1.23     Sec. 3.  Minnesota Statutes 1996, section 126.22, 
  1.24  subdivision 3, is amended to read: 
  1.25     Subd. 3.  [ELIGIBLE PROGRAMS.] (a) A pupil who is eligible 
  2.1   according to subdivision 2 may enroll in area learning centers 
  2.2   under sections 124C.45 to 124C.48, or according to section 
  2.3   121.11, subdivision 12. 
  2.4      (b) A pupil who is eligible according to subdivision 2 and 
  2.5   who is between the ages of 16 and 21 may enroll in 
  2.6   post-secondary courses under section 123.3514. 
  2.7      (c) A pupil who is eligible under subdivision 2, may enroll 
  2.8   in any public elementary or secondary education program.  
  2.9   However, a person who is eligible according to subdivision 2, 
  2.10  clause (b), may enroll only if the school board has adopted a 
  2.11  resolution approving the enrollment. 
  2.12     (d) A pupil who is eligible under subdivision 2, may enroll 
  2.13  in any nonprofit, nonpublic, nonsectarian school that has 
  2.14  contracted with the serving school district to provide 
  2.15  educational services. 
  2.16     (e) A pupil who is between the ages of 16 and 21 may enroll 
  2.17  in any adult basic education programs approved under section 
  2.18  124.26 and operated under the community education program 
  2.19  contained in section 121.88. 
  2.20     Sec. 4.  Minnesota Statutes 1996, section 126.22, 
  2.21  subdivision 3a, is amended to read: 
  2.22     Subd. 3a.  [ADDITIONAL ELIGIBLE PROGRAM.] A pupil who is at 
  2.23  least 16 years of age, who is eligible under subdivision 2, 
  2.24  clause (a), and who has been enrolled only in a public school, 
  2.25  if the pupil has been enrolled in any school, during the year 
  2.26  immediately before transferring under this subdivision, may 
  2.27  transfer to any nonprofit, nonpublic school that has contracted 
  2.28  with the serving school district to provide nonsectarian 
  2.29  educational services.  Such a school must enroll every eligible 
  2.30  pupil who seeks to transfer to the school under this program 
  2.31  subject to available space.
