  1.1                          A bill for an act
  1.2             relating to education; making teacher licenses 
  1.3             continuous; amending Minnesota Statutes 1994, sections 
  1.4             125.05, subdivision 2; 125.08; and 136C.04, 
  1.5             subdivision 9. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 125.05, 
  1.8   subdivision 2, is amended to read: 
  1.9      Subd. 2.  [EXPIRATION AND RENEWAL CONTINUOUS EFFECT.] Each 
  1.10  license issued through the licensing section of the department 
  1.11  of education must bear the date of issue.  Except as otherwise 
  1.12  provided in this section and subject to section 125.09, licenses 
  1.13  must expire and be renewed in accordance with the respective 
  1.14  rules adopted by of the board of teaching or and the state board 
  1.15  of education remain in continuous effect.  Requirements for 
  1.16  renewal of a license must include production of satisfactory 
  1.17  evidence of successful teaching experience for at least one 
  1.18  school year during the period covered by the license in grades 
  1.19  or subjects for which the license is valid or completion of such 
  1.20  additional preparation as the board of teaching shall 
  1.21  prescribe.  Requirements for renewal of the licenses of 
  1.22  supervisory personnel must be established by the state board of 
  1.23  education.  
  1.24     Sec. 2.  Minnesota Statutes 1994, section 125.08, is 
  1.25  amended to read: 
  2.1      125.08 [TEACHERS' AND ADMINISTRATORS' LICENSES, FEES.] 
  2.2      Each application for the issuance, renewal, or extension of 
  2.3   a license to teach must be accompanied by a processing fee in an 
  2.4   amount set by the board of teaching by rule.  Each application 
  2.5   for the issuance, renewal, or extension of a license as 
  2.6   supervisory personnel must be accompanied by a processing fee in 
  2.7   an amount set by the state board of education by rule.  The 
  2.8   processing fee for a teacher's license must be paid to the 
  2.9   executive secretary of the board of teaching.  The processing 
  2.10  fee for the licenses of supervisory personnel must be paid to 
  2.11  the commissioner.  The executive secretary of the board of 
  2.12  teaching and the commissioner shall deposit the fees with the 
  2.13  state treasurer, as provided by law, and report each month to 
  2.14  the commissioner of finance the amount of fees collected.  The 
  2.15  fees as set by the boards are nonrefundable for applicants not 
  2.16  qualifying for a license.  However, a fee must be refunded by 
  2.17  the state treasurer in any case in which the applicant already 
  2.18  holds a valid unexpired license.  The boards may waive or reduce 
  2.19  fees for applicants who apply at the same time for more than one 
  2.20  license, even if the licenses are under the jurisdiction of 
  2.21  different boards.  
  2.22     Sec. 3.  Minnesota Statutes 1994, section 136C.04, 
  2.23  subdivision 9, is amended to read: 
  2.24     Subd. 9.  [LICENSURE.] The state board may adopt rules 
  2.25  under chapter 14 for licensure providing continuous licenses of 
  2.26  teaching, support, and supervisory personnel in post-secondary 
  2.27  and adult vocational education.  When necessary for continuous 
  2.28  programs approved by the board and when the board determines 
  2.29  that appropriate licensure standards do not exist, the state 
  2.30  board may adopt appropriate temporary standards without regard 
  2.31  to chapter 14 and may issue temporary licenses to teaching and 
  2.32  support personnel.  A temporary license is valid for up to one 
  2.33  year and is not renewable, but a person holding a temporary 
  2.34  license may, upon its expiration, be issued a license in 
  2.35  accordance with standards adopted under chapter 14.  The state 
  2.36  board may establish a processing fee for the issuance, renewal, 
  3.1   or extension of a license.  The state board may suspend or 
  3.2   revoke a license for cause on the same grounds as provided in 
  3.3   section 125.09, subdivision 1.
