  1.1                          A bill for an act 
  1.2             relating to jails; establishing booking fees for local 
  1.3             jails and procedures for collection; amending 
  1.4             Minnesota Statutes 1996, section 641.12.  
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1996, section 641.12, is 
  1.7   amended to read: 
  1.8      641.12 [COLLECTION OF FEES AND BOARD BILLS.] 
  1.9      Subdivision 1.  [FEE.] Each person who is booked at a 
  1.10  county or regional jail, whether or not released upon completion 
  1.11  of the booking process, shall pay a fee of $10 to the sheriff's 
  1.12  department of the county in which the jail is located.  The fee 
  1.13  is payable immediately from any money then possessed by the 
  1.14  person being booked, or any money deposited with the sheriff's 
  1.15  department on the person's behalf.  If the person has no funds 
  1.16  at the time of booking or during the period of any 
  1.17  incarceration, the sheriff shall notify the district court in 
  1.18  the county where the charges related to the booking are pending, 
  1.19  and shall request the assessment of the fee.  Notwithstanding 
  1.20  section 609.10, 609.125, or any other law to the contrary, upon 
  1.21  notification from the sheriff, the district court must order the 
  1.22  fee paid to the sheriff's department as part of any sentence or 
  1.23  disposition imposed.  If the person is not charged, is 
  1.24  acquitted, or if the charges are dismissed, the sheriff shall 
  1.25  return the fee to the person at the last known address listed in 
  2.1   the booking records.  
  2.2      Subd. 2.  [BOARD.] At the end of every month the sheriff of 
  2.3   each county shall render to the county auditor a statement 
  2.4   showing the name of each fugitive from justice, United States 
  2.5   prisoner, one committed from another county or one committed by 
  2.6   virtue of any city ordinance, the amount due the county for 
  2.7   board of each and from whom, and also of all amounts due for 
  2.8   board of prisoners for the preceding month.
