  1.1                          A bill for an act
  1.2             relating to towns; clarifying the procedure to fill a 
  1.3             vacancy in the office of town supervisor; amending 
  1.4             Minnesota Statutes 1994, section 367.03, subdivision 6.
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1994, section 367.03, 
  1.7   subdivision 6, is amended to read: 
  1.8      Subd. 6.  [VACANCIES.] When a vacancy occurs in a town 
  1.9   office, the town board shall fill the vacancy by appointment.  
  1.10  The person appointed shall hold office until the next annual 
  1.11  town election, when a successor shall be elected for the 
  1.12  unexpired term.  A vacancy in the office of supervisor shall be 
  1.13  filled by an appointment committee comprised of the remaining 
  1.14  supervisors and the town clerk until the next annual town 
  1.15  election, when a successor shall be elected for the unexpired 
  1.16  term.  Any person appointed to fill the vacancy in the office of 
  1.17  supervisor shall meet the requirements of section 204B.06, 
  1.18  subdivision 1, clauses (a) and (c).  When, because of a vacancy, 
  1.19  more than one supervisor is to be chosen at the same election, 
  1.20  candidates for the offices of supervisor shall file for one of 
  1.21  the specific terms being filled.  Law enforcement vacancies 
  1.22  shall be filled by appointment by the town board.  
  1.23     Sec. 2.  [EFFECTIVE DATE.] 
  1.24     This act is effective the day after final enactment.
