1.1 A bill for an act 1.2 relating to crime prevention; expanding the 1.3 fourth-degree assault law; amending Minnesota Statutes 1.4 2002, section 609.2231, subdivision 3. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 2002, section 609.2231, 1.7 subdivision 3, is amended to read: 1.8 Subd. 3. [CORRECTIONALEMPLOYEESAND SECURE TREATMENT 1.9 FACILITY PERSONNEL.] Whoever commits either of the following 1.10 acts against an employee of a correctional facility as defined 1.11 in section 241.021, subdivision 1, clause (5), or an employee or 1.12 other individual who provides care or treatment at a secure 1.13 treatment facility as defined in section 253B.02, subdivision 1.14 18a, while theemployeeperson is engaged in the performance of 1.15 a duty imposed by law, policy, or rule is guilty of a felony and 1.16 may be sentenced to imprisonment for not more than two years or 1.17 to payment of a fine of not more than $4,000, or both: 1.18 (1) assaults theemployeeperson and inflicts demonstrable 1.19 bodily harm; or 1.20 (2) intentionally throws or otherwise transfers bodily 1.21 fluids or feces at or onto theemployeeperson. 1.22 Sec. 2. [EFFECTIVE DATE.] 1.23 Section 1 is effective August 1, 2003, and applies to 1.24 crimes committed on or after that date.
