  1.1                          A bill for an act 
  1.2             relating to professions; extending the expiration date 
  1.3             of the acupuncture, respiratory care practitioner, 
  1.4             licensed traditional midwifery, and health 
  1.5             professionals services program advisory committees; 
  1.6             amending Minnesota Statutes 2002, sections 147B.05, 
  1.7             subdivision 2; 147C.35, subdivision 2; 147D.25, 
  1.8             subdivision 2; 214.32, subdivision 1. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2002, section 147B.05, 
  1.11  subdivision 2, is amended to read: 
  1.12     Subd. 2.  [ADMINISTRATION; COMPENSATION; REMOVAL; QUORUM.] 
  1.13  The advisory council is governed by section 15.059, except that 
  1.14  the council does not expire until June 30, 2003 2007. 
  1.15     Sec. 2.  Minnesota Statutes 2002, section 147C.35, 
  1.16  subdivision 2, is amended to read: 
  1.17     Subd. 2.  [ORGANIZATION.] The advisory council shall be 
  1.18  organized and administered under section 15.059.  The council 
  1.19  expires June 30, 2003 2007. 
  1.20     Sec. 3.  Minnesota Statutes 2002, section 147D.25, 
  1.21  subdivision 2, is amended to read: 
  1.22     Subd. 2.  [ORGANIZATION.] The advisory council shall be 
  1.23  organized and administered under section 15.059.  The council 
  1.24  expires June 30, 2003 2007. 
  1.25     Sec. 4.  Minnesota Statutes 2002, section 214.32, 
  1.26  subdivision 1, is amended to read: 
  1.27     Subdivision 1.  [MANAGEMENT.] (a) A health professionals 
  2.1   services program committee is established, consisting of one 
  2.2   person appointed by each participating board, with each 
  2.3   participating board having one vote.  The committee shall 
  2.4   designate one board to provide administrative management of the 
  2.5   program, set the program budget and the pro rata share of 
  2.6   program expenses to be borne by each participating board, 
  2.7   provide guidance on the general operation of the program, 
  2.8   including hiring of program personnel, and ensure that the 
  2.9   program's direction is in accord with its authority.  If the 
  2.10  participating boards change which board is designated to provide 
  2.11  administrative management of the program, any appropriation 
  2.12  remaining for the program shall transfer to the newly designated 
  2.13  board on the effective date of the change.  The participating 
  2.14  boards must inform the appropriate legislative committees and 
  2.15  the commissioner of finance of any change in the administrative 
  2.16  management of the program, and the amount of any appropriation 
  2.17  transferred under this provision. 
  2.18     (b) The designated board, upon recommendation of the health 
  2.19  professional services program committee, shall hire the program 
  2.20  manager and employees and pay expenses of the program from funds 
  2.21  appropriated for that purpose.  The designated board may apply 
  2.22  for grants to pay program expenses and may enter into contracts 
  2.23  on behalf of the program to carry out the purposes of the 
  2.24  program.  The participating boards shall enter into written 
  2.25  agreements with the designated board. 
  2.26     (c) An advisory committee is established to advise the 
  2.27  program committee consisting of: 
  2.28     (1) one member appointed by each of the following:  the 
  2.29  Minnesota Academy of Physician Assistants, the Minnesota Dental 
  2.30  Association, the Minnesota Chiropractic Association, the 
  2.31  Minnesota Licensed Practical Nurse Association, the Minnesota 
  2.32  Medical Association, the Minnesota Nurses Association, and the 
  2.33  Minnesota Podiatric Medicine Association; 
  2.34     (2) one member appointed by each of the professional 
  2.35  associations of the other professions regulated by a 
  2.36  participating board not specified in clause (1); and 
  3.1      (3) two public members, as defined by section 214.02.  
  3.2   Members of the advisory committee shall be appointed for two 
  3.3   years and members may be reappointed.  
  3.4      The advisory committee expires June 30, 2003 2007.  
  3.5      Sec. 5.  [EFFECTIVE DATE.] 
  3.6      Sections 1 to 4 are effective July 1, 2003.
