  1.1                          A bill for an act 
  1.2             relating to retirement; authorizing payment of refunds 
  1.3             from the Minnesota state retirement system for certain 
  1.4             employees on medical leaves of absence; amending 
  1.5             Minnesota Statutes 2002, section 352.22, subdivision 1.
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 352.22, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [SERVICE TERMINATION.] Any employee who 
  1.10  ceases to be a state employee by reason of termination of state 
  1.11  service or layoff or who has been on a medical leave of absence 
  1.12  for more than one year is entitled to a refund provided in 
  1.13  subdivision 2 or a deferred retirement annuity as provided in 
  1.14  subdivision 3.  Application for a refund may be made after the 
  1.15  termination of state service or layoff or medical leave of 
  1.16  absence for more than one year if the applicant has not again 
  1.17  become a state employee required to be covered by the system.  
  1.18     Sec. 2.  [EFFECTIVE DATE.] 
  1.19     Section 1 is effective the day following final enactment.  
  1.20  In addition to applying to a person who goes on medical leave of 
  1.21  absence after that date, the section also applies to a person 
  1.22  who is on medical leave on that date provided the person meets 
  1.23  the one-year requirement.
