  1.1                          A bill for an act 
  1.2             relating to human services; allowing counties to 
  1.3             authorize payment for services up to the statewide 
  1.4             maximum rate for services provided under the 
  1.5             alternative care and specified home and 
  1.6             community-based waivered services programs; amending 
  1.7             Minnesota Statutes 2000, sections 256B.0913, by adding 
  1.8             a subdivision; 256B.0915, by adding a subdivision; and 
  1.9             256B.49, by adding a subdivision. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  Minnesota Statutes 2000, section 256B.0913, is 
  1.12  amended by adding a subdivision to read: 
  1.13     Subd. 17.  [STATEWIDE MAXIMUM RATE.] (a) On or after July 
  1.14  1, 2001, counties shall authorize payment for alternative care 
  1.15  services up to the highest statewide maximum rate available for 
  1.16  the services under the elderly waiver, alternative care program, 
  1.17  community alternative care (CAC) waiver program, community 
  1.18  alternatives for disabled individuals (CADI) waiver program, 
  1.19  traumatic brain injury (TBI) waiver program, or medical 
  1.20  assistance home care. 
  1.21     (b) Counties shall exclude the traumatic brain injury (TBI) 
  1.22  waiver program rate, when determining the highest statewide 
  1.23  maximum rate for nursing services.  
  1.24     (c) This subdivision does not apply to payment rates for 
  1.25  assisted living and residential care services. 
  1.26     Sec. 2.  Minnesota Statutes 2000, section 256B.0915, is 
  1.27  amended by adding a subdivision to read: 
  2.1      Subd. 8.  [STATEWIDE MAXIMUM RATE.] (a) On or after July 1, 
  2.2   2001, counties shall authorize payment for elderly waiver 
  2.3   services up to the highest statewide maximum rate available for 
  2.4   the services under the elderly waiver, alternative care program, 
  2.5   community alternative care (CAC) waiver program, community 
  2.6   alternatives for disabled individuals (CADI) waiver program, 
  2.7   traumatic brain injury (TBI) waiver program, or medical 
  2.8   assistance home care. 
  2.9      (b) Counties shall exclude the traumatic brain injury (TBI) 
  2.10  waiver program rate, when determining the highest statewide 
  2.11  maximum rate for nursing services. 
  2.12     (c) This subdivision does not apply to payment rates for 
  2.13  assisted living and residential care services. 
  2.14     Sec. 3.  Minnesota Statutes 2000, section 256B.49, is 
  2.15  amended by adding a subdivision to read: 
  2.16     Subd. 11.  [STATEWIDE MAXIMUM RATE.] (a) Except as provided 
  2.17  in paragraphs (b) and (c), on or after July 1, 2001, counties 
  2.18  shall authorize payment for community alternative care (CAC), 
  2.19  community alternatives for disabled individuals (CADI), and 
  2.20  traumatic brain injury (TBI) services up to the highest 
  2.21  statewide maximum rate available for the services under the 
  2.22  elderly waiver program, alternative care program, community 
  2.23  alternative care (CAC) waiver program, community alternatives 
  2.24  for disabled individuals (CADI) waiver program, traumatic brain 
  2.25  injury (TBI) waiver program, or medical assistance home care. 
  2.26     (b) Counties shall exclude the traumatic brain injury (TBI) 
  2.27  waiver program rate, when determining the highest statewide 
  2.28  maximum rate for nursing services for programs other than the 
  2.29  traumatic brain injury (TBI) waiver program.  
  2.30     (c) This subdivision does not apply to payment rates for 
  2.31  assisted living and residential care services.
