  1.1                          A bill for an act 
  1.2             relating to commerce; requiring inspections of, 
  1.3             reports on, and training for tobacco retailers and 
  1.4             employees; proposing coding for new law in Minnesota 
  1.5             Statutes, chapter 461.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [461.16] [TOBACCO SALES LOCATIONS; INSPECTIONS, 
  1.8   REPORTS.] 
  1.9      Each statutory or home rule charter city and, in those 
  1.10  areas of each county outside of the cities, the county, shall 
  1.11  coordinate annual, random, unannounced inspections at locations 
  1.12  where tobacco products are sold to test compliance with section 
  1.13  609.685 and to conform with the requirements of federal law.  
  1.14  The inspections shall be performed by local units of 
  1.15  government.  A person no younger than 15 and no older than 17 
  1.16  shall assist in the tests of compliance only under the 
  1.17  supervision of a law officer or an employee of the city or 
  1.18  county and only with the written consent of a parent.  Each city 
  1.19  or county which performs compliance checks shall report results 
  1.20  to the commissioner of human services.  The commissioner shall 
  1.21  annually submit the report required by United States Code, title 
  1.22  42, section 300x-26, and otherwise ensure the state's compliance 
  1.23  with that law and any regulations adopted to implement it.  
  1.24     Sec. 2.  [461.17] [TOBACCO PRODUCT SALESPERSONS; TRAINING.] 
  1.25     The employer at each retail location where tobacco products 
  2.1   are sold shall conduct a training program for the individuals 
  2.2   who sell tobacco products at the location that instructs them 
  2.3   about the law, the related penalties, and the employer's policy 
  2.4   with regard to tobacco sales.  The commissioner of public safety 
  2.5   may impose an administrative penalty of not more than $100 upon 
  2.6   the retailer at each location where the employer has not 
  2.7   provided training as required by this section.  If an inspection 
  2.8   at any location discloses a violation of section 609.685, notice 
  2.9   shall be given to the employer, and the employees shall be 
  2.10  retrained as provided by this section. 
  2.11     Sec. 3.  [EFFECTIVE DATE.] 
  2.12     Sections 1 and 2 are effective January 1, 1996.
