  1.1                          A bill for an act
  1.2             relating to alcoholic beverages; restricting sale and 
  1.3             possession of malt liquor in containers of more than 
  1.4             five liters; amending Minnesota Statutes 1994, section 
  1.5             340A.310; proposing coding for new law in Minnesota 
  1.6             Statutes, chapter 340A. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 340A.310, is 
  1.9   amended to read: 
  1.10     340A.310 [SALES BY WHOLESALERS.] 
  1.11     Subdivision 1.  [LAWFUL SALES.] A wholesaler may sell 
  1.12  intoxicating liquor or 3.2 percent malt liquor only to municipal 
  1.13  liquor stores, government instrumentalities, or holders of 
  1.14  alcoholic beverage licenses issued under this chapter. 
  1.15     Subd. 2.  [SALES OF CERTAIN CONTAINERS OF MALT LIQUOR.] A 
  1.16  malt liquor wholesaler may sell a container containing more than 
  1.17  five liters of malt liquor only to a holder of an on-sale 
  1.18  alcoholic beverage license or a municipal liquor store that 
  1.19  sells alcoholic beverages at on-sale. 
  1.20     Sec. 2.  [340A.511] [SALE AND POSSESSION OF CERTAIN 
  1.21  CONTAINERS PROHIBITED.] 
  1.22     Subdivision 1.  [SALES PROHIBITED.] A retailer of alcoholic 
  1.23  beverages may not sell for off-premise consumption any container 
  1.24  containing more than five liters of malt liquor. 
  1.25     Subd. 2.  [POSSESSION PROHIBITED.] No person other than a 
  1.26  wholesaler of malt liquor, licensed on-sale retailer, or 
  2.1   municipal liquor store may possess a container containing more 
  2.2   than five liters of malt liquor without written permission of 
  2.3   the commissioner.
