A bill for an act
relating to public safety; establishing a searchable database for traffic law
enforcement; requiring a report; proposing coding for new law in Minnesota
Statutes, chapter 169.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) The commissioner must establish and maintain
a central searchable database of information pertaining to traffic law enforcement by local
law enforcement officers and the State Patrol.

new text begin (b) The information contained in the database is public data under section 13.03 and
must be made available to the public on the department's website.

new text begin Quarterly report required. new text end

new text begin All local law enforcement agencies and the State
Patrol must submit a quarterly report to the commissioner containing the following
information, which shall be included in the database established in subdivision 1:

new text begin (1) the number of drivers stopped for traffic violations under this chapter by law
enforcement officers, the officer making each stop, the date each stop was made, the law
enforcement agency of the officer making each stop, and whether a citation or warning was
issued for the violation;

new text begin (2) identifying characteristics of the drivers stopped, including their race or ethnicity,
approximate age, and gender;
new text end

new text begin (3) the alleged traffic violation that led to the stop;
new text end

new text begin (4) whether a search was instituted as a result of the stop;
new text end

new text begin (5) whether the vehicle, personal items, driver, or passenger were searched and the race
or ethnicity, approximate age, and gender of each person searched;

new text begin (6) whether the search was conducted pursuant to consent, probable cause, or a warrant,
including the basis for the request for consent, the circumstances establishing probable
cause, or the basis for the warrant;

new text begin (7) whether any contraband was found and the type and amount of any such contraband;
new text end

new text begin (8) whether any written citation or any oral or written warning was issued as a result of
the stop;
new text end

new text begin (9) whether an arrest was made as a result of either the stop or the search;
new text end

new text begin (10) whether any property was seized, including a description of that property;
new text end

new text begin (11) whether the officer making the stop encountered any physical resistance from the
driver or a passenger;
new text end

new text begin (12) whether the officer making the stop engaged in the use of force against the driver
or a passenger for any reason;
new text end

new text begin (13) whether any injuries resulted from the stop;
new text end

new text begin (14) whether the circumstances surrounding the stop were the subject of any investigation
and the results of that investigation; and

new text begin (15) the geographic location of the stop. If the officer making the stop is a member of
the State Patrol, the location must include the district number and station number. For all
other law enforcement officers, the location must include the municipality and county in
which the stop was made.
