  1.1                          A bill for an act 
  1.2             relating to counties; requiring each county to adopt 
  1.3             an emergency management plan by January 2005; amending 
  1.4             Minnesota Statutes 2002, section 12.25, subdivision 2. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2002, section 12.25, 
  1.7   subdivision 2, is amended to read: 
  1.8      Subd. 2.  [COUNTIES; DIRECTOR, RESPONSIBILITIES.] (a) Each 
  1.9   county emergency management organization must have a director 
  1.10  and one or more deputy directors.  They must be appointed by the 
  1.11  county board. 
  1.12     (b) A county organization for emergency management has 
  1.13  jurisdiction throughout the county outside of a city or of a 
  1.14  town that has a local emergency management organization. 
  1.15     (c) In addition to the other powers granted by this 
  1.16  subdivision, county organizations shall: 
  1.17     (1) coordinate the activities of and may assist in the 
  1.18  training of emergency management organizations of political 
  1.19  subdivisions throughout the county; 
  1.20     (2) plan for the emergency operations of county government 
  1.21  in cooperation with the county attorney, who shall give legal 
  1.22  advice to the county organization, and with other appropriate 
  1.23  county government officials and private sector representatives; 
  1.24     (3) adopt by January 1, 2005, and periodically review and 
  1.25  update a plan for responding to emergencies, including but not 
  2.1   limited to natural disasters and acts of war or terrorism; 
  2.2      (4) acquire equipment necessary in connection with these 
  2.3   activities; and 
  2.4      (4) (5) expend funds provided by the county board out of 
  2.5   general revenue funds for such purposes.
