  1.1                          A bill for an act 
  1.2             relating to motor vehicles; allocating revenues from 
  1.3             motor vehicle sales tax; proposing amendment to 
  1.4             Minnesota Constitution, article XIV, by adding a 
  1.5             section to require certain portion of revenue from 
  1.6             sales tax on motor vehicles be deposited in highway 
  1.7             user tax distribution fund; amending Minnesota 
  1.8             Statutes 2000, section 297B.09, subdivision 1. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2000, section 297B.09, 
  1.11  subdivision 1, is amended to read: 
  1.12     Subdivision 1.  [GENERAL FUND SHARE.] Money collected and 
  1.13  received under this chapter must be deposited as provided in 
  1.14  this subdivision.  
  1.15     Thirty-two Fifty percent of the money collected and 
  1.16  received must be deposited in the highway user tax distribution 
  1.17  fund, and the remaining 68 50 percent of the money must be 
  1.18  deposited in the general fund.  
  1.19     Sec. 2.  [CONSTITUTIONAL AMENDMENT PROPOSED.] 
  1.20     An amendment to the Minnesota Constitution, article XIV, is 
  1.21  proposed to the people.  If adopted, the article will be amended 
  1.22  by adding a section to read: 
  1.23     Sec. 12.  Of the proceeds of any tax levied by law on the 
  1.24  sale price of new and used motor vehicles, not less than 50 
  1.25  percent must be paid into the highway user tax distribution fund.
  1.26     Sec. 3.  [SUBMISSION TO VOTERS.] 
  1.27     The constitutional amendment proposed in section 2 must be 
  2.1   submitted at the 2002 general election.  The question submitted 
  2.2   must be: 
  2.3      "Shall the Minnesota Constitution be amended to require 
  2.4   that of the proceeds from a sales tax on new and used motor 
  2.5   vehicles at least 50 percent must be paid into the highway user 
  2.6   tax distribution fund? 
  2.7                                      Yes .......
  2.8                                      No ........"
  2.9      Sec. 4.  [EFFECTIVE DATE.] 
  2.10     Section 1 is effective for money collected and received 
  2.11  after June 30, 2002.
