  1.1                          A bill for an act 
  1.2             relating to drivers' licenses; providing for 
  1.3             expiration of licenses and identification cards of 
  1.4             persons lawfully in the United States for specified 
  1.5             periods; making clarifying changes; amending Minnesota 
  1.6             Statutes 2002, sections 171.07, subdivision 4; 171.27. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 171.07, 
  1.9   subdivision 4, is amended to read: 
  1.10     Subd. 4.  [EXPIRATION.] (a) Except as otherwise provided in 
  1.11  this subdivision, the expiration date of Minnesota 
  1.12  identification cards of applicants under the age of 65 shall be 
  1.13  is the birthday of the applicant in the fourth year following 
  1.14  the date of issuance of the card. 
  1.15     (b) Minnesota identification cards issued to applicants age 
  1.16  65 or over shall be are valid for the lifetime of the applicant. 
  1.17     (c) The expiration date for an Under-21 identification card 
  1.18  is the cardholder's 21st birthday.  The commissioner shall issue 
  1.19  an identification card to a holder of an Under-21 identification 
  1.20  card who applies for the card, pays the required fee, and 
  1.21  presents proof of identity and age, unless the commissioner 
  1.22  determines that the applicant is not qualified for the 
  1.23  identification card. 
  1.24     (d) Except as otherwise provided in this paragraph, the 
  1.25  expiration date for an identification card issued to a person 
  1.26  who is lawfully in the United States as a result of a document 
  2.1   issued by the United States Immigration and Naturalization 
  2.2   Service or successor agency that authorizes the person to remain 
  2.3   in the United States until a specified date is the date on which 
  2.4   that authorization expires, the date on which the authorization 
  2.5   is terminated, or four years after the date of issuance of the 
  2.6   identification card, whichever occurs first.  In the case of an 
  2.7   Under-21 identification card issued to a person described in 
  2.8   this paragraph, the expiration date is the cardholder's 21st 
  2.9   birthday or the date on which the person's authorization to 
  2.10  remain in the United States expires or is terminated, whichever 
  2.11  occurs first.  An identification card issued with an expiration 
  2.12  date that is the date on which the cardholder's authorization to 
  2.13  remain in the United States expires must be (1) of a 
  2.14  distinguishing color, (2) plainly marked "nonrenewable," and (3) 
  2.15  clearly marked for law enforcement purposes on the back of the 
  2.16  card in a code no larger than other information contained on the 
  2.17  back of the card.  This paragraph supersedes any provision to 
  2.18  the contrary in paragraphs (a) through (c).  
  2.19     Sec. 2.  Minnesota Statutes 2002, section 171.27, is 
  2.20  amended to read: 
  2.21     171.27 [EXPIRATION OF LICENSE.] 
  2.22     Subdivision 1.  [GENERALLY.] Except as otherwise provided 
  2.23  in this section, the expiration date for each driver's license, 
  2.24  other than under-21 licenses, is the birthday of the driver in 
  2.25  the fourth year following the date of issuance of the license.  
  2.26  The birthday of the driver shall must be as indicated on the 
  2.27  application for a driver's license.  A license may be renewed on 
  2.28  or before expiration or within one year after expiration upon 
  2.29  application, payment of the required fee, and passing the 
  2.30  examination required of all drivers for renewal.  The 
  2.31  commissioner shall extend or renew the driving privileges shall 
  2.32  be extended or renewed on or preceding the expiration date of an 
  2.33  existing driver's license unless the commissioner believes that 
  2.34  the licensee is no longer qualified as a driver.  
  2.35     Subd. 2.  [UNDER-21 LICENSE.] The expiration date for each 
  2.36  Under-21 license shall be is the 21st birthday of the licensee.  
  3.1   Upon the licensee attaining the age of 21 and upon the 
  3.2   application, payment of the required fee, and passing the 
  3.3   examination required of all drivers for renewal, a driver's 
  3.4   license shall must be issued unless the commissioner determines 
  3.5   that the licensee is no longer qualified as a driver. 
  3.6      Subd. 3.  [PROVISIONAL LICENSE.] The expiration date for 
  3.7   each provisional license is two years after the date of 
  3.8   application for the provisional license. 
  3.9      Subd. 4.  [LICENSE ISSUED TO PERSON IN UNITED STATES ON 
  3.10  TEMPORARY AUTHORITY.] (a) Except as otherwise provided in this 
  3.11  subdivision, the expiration date for a driver's license issued 
  3.12  to a person who is lawfully in the United States as a result of 
  3.13  a document issued by the United States Immigration and 
  3.14  Naturalization Service or successor agency that authorizes the 
  3.15  person to remain in the United States until a specified date is 
  3.16  the date on which that authorization expires, the date on which 
  3.17  the authorization is terminated, or four years after the date of 
  3.18  issuance of the license, whichever occurs first.  
  3.19     (b) In the case of an Under-21 license issued to a person 
  3.20  described in this subdivision, the expiration date is the 
  3.21  cardholder's 21st birthday or the date on which the person's 
  3.22  authorization to remain in the United States expires or is 
  3.23  terminated, whichever occurs first.  
  3.24     (c) In the case of a provisional license issued to a person 
  3.25  described in this subdivision, the expiration date is the date 
  3.26  on which the person's authorization to remain in the United 
  3.27  States expires or is terminated or two years after the date of 
  3.28  application for the provisional license, whichever occurs first. 
  3.29     (d) A license issued with an expiration date that is the 
  3.30  date on which the cardholder's authorization to remain in the 
  3.31  United States expires must be (1) of a distinguishing color, (2) 
  3.32  plainly marked "nonrenewable," and (3) clearly marked for law 
  3.33  enforcement purposes on the back of the card in a code no larger 
  3.34  than other information contained on the back of the card.  
  3.35     (e) This subdivision supersedes any provision to the 
  3.36  contrary in subdivisions 1 through 3. 
  4.1      Subd. 5.  [LICENSES TO PERSONS ON ACTIVE DUTY.] Any valid 
  4.2   Minnesota driver's license issued to a person then or 
  4.3   subsequently on active duty with the Armed Forces of the United 
  4.4   States, or the person's spouse, shall continue continues in full 
  4.5   force and effect without requirement for renewal until 90 days 
  4.6   after the date of the person's discharge from such service, 
  4.7   provided that a spouse's license must be renewed if the spouse 
  4.8   is residing within the state at the time the license expires or 
  4.9   within 90 days after the spouse returns to Minnesota and resides 
  4.10  within the state.
