  1.1                          A bill for an act 
  1.2             relating to insurance; homeowner's; requiring prompt 
  1.3             payment of claims; providing remedies; proposing 
  1.4             coding for new law in Minnesota Statutes, chapter 65A. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [65A.285] [PROMPT PAYMENT OF HOMEOWNER'S 
  1.7   CLAIMS.] 
  1.8      Subdivision 1.  [REQUIREMENT.] The amount of loss for which 
  1.9   an insurer is liable under a policy of homeowner's insurance 
  1.10  must be payable to the insured within 30 days after proof of 
  1.11  loss as provided in section 65A.01 is received by the insurer. 
  1.12     This section supersedes any inconsistent provision of 
  1.13  section 65A.01 or 72A.201, or other law. 
  1.14     Subd. 2.  [PRIVATE RIGHT OF ACTION.] A person injured by a 
  1.15  violation of this section may recover damages, together with 
  1.16  costs and disbursements, including costs of investigation and 
  1.17  reasonable attorney's fees, and receive other equitable relief 
  1.18  as determined by the court. 
  1.19     Sec. 2.  [EFFECTIVE DATE; APPLICATION.] 
  1.20     Section 1 is effective the day following final enactment 
  1.21  and applies to losses on or after that date.
