1.2relating to residential construction; amending the State Building Code; modifying
1.3licensing requirements;amending Minnesota Statutes 2008, sections 326B.106,
1.4by adding a subdivision; 326B.805, by adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2008, section 326B.106, is amended by adding a
1.7subdivision to read:
1.8    Subd. 13. Lead poisoning prevention. The code must require that any remodeling
1.9performed on residential property or child-occupied facilities constructed prior to 1978
1.10comply with Code of Federal Regulations, title 40, sections 745.80 to 745.89.
1.11EFFECTIVE DATE.This section is effective January 1, 2011.

1.12    Sec. 2. Minnesota Statutes 2008, section 326B.805, is amended by adding a
1.13subdivision to read:
1.14    Subd. 1a. Pre-1978 structures. Any person licensed under this section performing
1.15work on a residential structure or child-occupied facility constructed prior to 1978 must
1.16be certified to do lead work in accordance with Code of Federal Regulations, title 40,
1.17sections 745.80 to 745.89. Before the commencement of work on a residential structure or
1.18child-occupied facility constructed prior to 1978, a licensee working on the structure must
1.19provide to the commissioner proof of certification to do lead work. Licenses issued under
1.20this section must state whether the licensee is certified to do lead work on residential
1.21property or child-occupied facilities constructed prior to 1978. If the licensee is certified,
1.22the license must state the expiration date of the lead certification.
2.1EFFECTIVE DATE.This section is effective January 1, 2011.
