A bill for an act
relating to residential construction; amending the State Building Code; modifying
licensing requirements; amending Minnesota Statutes 2008, sections 326B.106,
by adding a subdivision; 326B.805, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 326B.106, is amended by adding a
subdivision to read:

performed on residential property or child-occupied facilities constructed prior to 1978
comply with Code of Federal Regulations, title 40, sections 745.80 to 745.89.

Sec. 2.

Minnesota Statutes 2008, section 326B.805, is amended by adding a
subdivision to read:

new text begin Any person licensed under this section performing
work on a residential structure or child-occupied facility constructed prior to 1978 must
be certified to do lead work in accordance with Code of Federal Regulations, title 40,
sections 745.80 to 745.89. Before the commencement of work on a residential structure or
child-occupied facility constructed prior to 1978, a licensee working on the structure must
provide to the commissioner proof of certification to do lead work. Licenses issued under
this section must state whether the licensee is certified to do lead work on residential
property or child-occupied facilities constructed prior to 1978. If the licensee is certified,
the license must state the expiration date of the lead certification.
