1.1A bill for an act
1.2proposing an amendment to the Minnesota Constitution, article VII, section 1;
1.3requiring voters to present photographic identification or equivalent; providing
1.4photographic identification to voters at no charge; requiring substantially
1.5equivalent verification standards for all voters.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. CONSTITUTIONAL AMENDMENT PROPOSED.
1.8An amendment to the Minnesota Constitution is proposed to the people. If the
1.9amendment is adopted, article VII, section 1, will read:
1.10Section 1. (a) Every person 18 years of age or more who has been a citizen of the United
1.11States for three months and who has resided in the precinct for 30 days next preceding
1.12an election; who, at the time of voting in person, shall present government-issued
1.13photographic identification or equivalent as prescribed by law, or who, when not voting in
1.14person, shall provide government-issued proof of identity as prescribed by law; shall be
1.15entitled to vote in that precinct. The state must make photographic identification available
1.16to eligible individuals at no charge as prescribed by law. The place of voting by one
1.17otherwise qualified who has changed his residence within 30 days preceding the election
1.18shall be prescribed by law. The following persons shall not be entitled or permitted to
1.19vote at any election in this state: A person not meeting the above requirements; a person
1.20who has been convicted of treason or felony, unless restored to civil rights; a person
1.21under guardianship, or a person who is insane or not mentally competent. All voters
1.22must be subject to substantially equivalent state eligibility verification prior to a ballot
1.23being cast or counted.
2.1(b) A voter who is unable to present government-issued photographic identification
2.2or equivalent when voting in person must be permitted to submit a provisional ballot
2.3as prescribed by law. Absentee ballots shall be counted if government-issued photo
2.4identification or equivalent or government-issued proof of identity is presented or
2.5provided as prescribed by law.

2.6    Sec. 2. SUBMISSION TO VOTERS.
2.7The proposed amendment must be submitted to the people at the 2012 general
2.8election. If approved, the amendment is effective for elections on or after December
2.91, 2013. The question submitted must be:
2.10"Shall the Minnesota Constitution be amended effective December 1, 2013, to require
2.11that all in-person voters present an approved form of government-issued photographic
2.12identification or equivalent at the time of voting; that those not voting in person provide
2.13government-issued proof of identity; that all voters be subject to substantially equivalent
2.14eligibility verification before a ballot is cast or counted; and that the state provide at no
2.15charge an approved photographic identification to eligible individuals?
