  1.1                          A bill for an act 
  1.2             relating to public safety; modifying 911 emergency 
  1.3             telecommunications provisions governing multiline 
  1.4             telephone systems; amending Minnesota Statutes 2002, 
  1.5             sections 403.01, subdivision 6; 403.02, by adding 
  1.6             subdivisions; 403.07, subdivision 5; proposing coding 
  1.7             for new law in Minnesota Statutes, chapter 403. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 403.01, 
  1.10  subdivision 6, is amended to read: 
  1.11     Subd. 6.  [MULTISTATION OR PBX SYSTEM.] Every owner and 
  1.12  operator of a multistation or private branch exchange (PBX) 
  1.13  telecommunications multiline telephone system, or a similar 
  1.14  system using devices with telephone functionality such as 
  1.15  voice-over-Internet protocol, shall design and maintain the 
  1.16  system to dial the 911 number without charge to the caller and 
  1.17  provide a call back number and emergency response location as 
  1.18  required by section 403.15. 
  1.19     Sec. 2.  Minnesota Statutes 2002, section 403.02, is 
  1.20  amended by adding a subdivision to read: 
  1.21     Subd. 22.  [CALL BACK NUMBER.] "Call back number" means a 
  1.22  number used by the public safety answering point to recontact 
  1.23  the location from which the 911 call was placed.  
  1.24     Sec. 3.  Minnesota Statutes 2002, section 403.02, is 
  1.25  amended by adding a subdivision to read: 
  1.26     Subd. 23.  [EMERGENCY LOCATION IDENTIFICATION 
  2.1   NUMBER.] "Emergency location identification number" means a 
  2.2   valid North American numbering plan format telephone number, 
  2.3   assigned to the multiline telephone system operator by the 
  2.4   appropriate authority, that is used to route the call to a 
  2.5   public safety answering point and is used to retrieve the 
  2.6   automatic location identification for the public safety 
  2.7   answering point.  
  2.8      Sec. 4.  Minnesota Statutes 2002, section 403.02, is 
  2.9   amended by adding a subdivision to read: 
  2.10     Subd. 24.  [EMERGENCY RESPONSE LOCATION.] "Emergency 
  2.11  response location" means a location to which a 911 emergency 
  2.12  response team may be dispatched.  The location should be 
  2.13  specific enough to provide a reasonable opportunity for the 
  2.14  emergency response team to locate a caller anywhere within it.  
  2.15     Sec. 5.  Minnesota Statutes 2002, section 403.02, is 
  2.16  amended by adding a subdivision to read: 
  2.17     Subd. 25.  [MULTILINE TELEPHONE SYSTEM.] "Multiline 
  2.18  telephone system" means a private telephone system comprised of 
  2.19  common control units, telephones, and control hardware and 
  2.20  software that share a common interface to the public switched 
  2.21  telephone network.  This includes network and premises-based 
  2.22  systems and systems owned or leased by governmental agencies and 
  2.23  nonprofit entities, as well as for-profit businesses.  
  2.24     Sec. 6.  Minnesota Statutes 2002, section 403.02, is 
  2.25  amended by adding a subdivision to read: 
  2.26     Subd. 26.  [SHARED RESIDENTIAL MULTILINE TELEPHONE SYSTEM 
  2.27  SERVICE.] "Shared residential multiline telephone service" means 
  2.28  the use of a multiline telephone system to provide service to 
  2.29  residential facilities.  For purposes of this subdivision, 
  2.30  "residential facilities" means both single-family and 
  2.31  multifamily facilities including extended care facilities and 
  2.32  dormitories.  
  2.33     Sec. 7.  Minnesota Statutes 2002, section 403.07, 
  2.34  subdivision 5, is amended to read: 
  2.35     Subd. 5.  [LIABILITY.] (a) A wire line telecommunications 
  2.36  service provider, its employees, or its agents are not liable to 
  3.1   any person who uses enhanced 911 telecommunications service for 
  3.2   release of subscriber information required under this chapter to 
  3.3   any public safety answering point. 
  3.4      (b) A wire line telecommunications service provider is not 
  3.5   liable to any person for the good faith release to emergency 
  3.6   communications personnel of information not in the public 
  3.7   record, including, but not limited to, nonpublished or nonlisted 
  3.8   telephone numbers.  
  3.9      (c) A wire line telecommunications service provider, its 
  3.10  employees, or its agents are not liable to any person for civil 
  3.11  damages resulting from or caused by any act or omission in the 
  3.12  development, design, installation, operation, maintenance, 
  3.13  performance, or provision of enhanced 911 telecommunications 
  3.14  service, except for willful or wanton misconduct. 
  3.15     (d) A multiline telephone system manufacturer, provider, or 
  3.16  operator is not liable for any civil damages or penalties as a 
  3.17  result of any act or omission, except willful or wanton 
  3.18  misconduct, in connection with developing, adopting, operating, 
  3.19  or implementing any plan or system required by section 403.15.  
  3.20     Sec. 8.  [403.15] [MULTILINE TELEPHONE SYSTEM 911 
  3.21  REQUIREMENTS.] 
  3.22     Subdivision 1.  [MULTILINE TELEPHONE SYSTEM USER DIALING 
  3.23  INSTRUCTIONS.] Each multiline telephone system operator must 
  3.24  demonstrate or otherwise inform each new telephone system user 
  3.25  how to call for emergency assistance from that particular 
  3.26  multiline telephone system.  
  3.27     Subd. 2.  [SHARED RESIDENTIAL MULTILINE TELEPHONE SYSTEM.] 
  3.28  After January 1, 2005, operators of shared multiline telephone 
  3.29  systems serving residential customers shall ensure that the 
  3.30  shared system is connected to the public switched network and 
  3.31  that 911 calls from this system result in at least one 
  3.32  distinctive automatic number identification and automatic 
  3.33  location identification for each residential unit.  This 
  3.34  requirement does not apply if the residential facility maintains 
  3.35  one of the following: 
  3.36     (1) automatic location identification for each respective 
  4.1   emergency response location; 
  4.2      (2) the ability to direct emergency responders to the 911 
  4.3   caller's location through an alternative and adequate means, 
  4.4   such as the establishment of a 24-hour private answering point; 
  4.5   or 
  4.6      (3) a connection to a switchboard operator, attendant, or 
  4.7   other designated on-site individual.  
  4.8      Subd. 3.  [HOTEL AND MOTEL MULTILINE TELEPHONE SYSTEM.] 
  4.9   Operators of hotel and motel multiline telephone systems shall 
  4.10  permit the dialing of 911 and shall ensure that 911 calls 
  4.11  originating from hotel or motel multiline telephone systems 
  4.12  allow the 911 system to clearly identify the address and 
  4.13  specific location of the 911 caller. 
  4.14     Subd. 4.  [BUSINESS MULTILINE TELEPHONE SYSTEM.] (a) An 
  4.15  operator of business multiline telephone systems connected to 
  4.16  the public switched telephone network and serving business 
  4.17  locations of one employer shall ensure that calls to 911 from 
  4.18  any telephone on the system result in one of the following: 
  4.19     (1) automatic location identification for each respective 
  4.20  emergency response location; or 
  4.21     (2) an ability to direct emergency responders to the 911 
  4.22  caller's location through an alternative and adequate means, 
  4.23  such as the establishment of a 24-hour private answering point; 
  4.24  or 
  4.25     (3) a connection to a switchboard operator, attendant, or 
  4.26  other designated on-site individual.  
  4.27     (b) Except as provided in paragraph (c), providers of 
  4.28  shared telecommunications services subject to this section 
  4.29  serving multiple employers' business locations shall ensure that 
  4.30  calls to 911 from any telephone result in automatic location 
  4.31  identification for the respective emergency response location of 
  4.32  each business location sharing the telecommunication services.  
  4.33     (c) Only one emergency response location is required in the 
  4.34  following circumstances: 
  4.35     (1) an employer's workspace is less than 40,000 square 
  4.36  feet, located on a single floor and on a single contiguous 
  5.1   property; 
  5.2      (2) an employer's workspace is less than 7,000 square feet, 
  5.3   located on multiple floors and on a single contiguous property; 
  5.4   and 
  5.5      (3) an employer's workspace is a single public entrance, 
  5.6   single floor facility on a single contiguous property. 
  5.7      Subd. 5.  [EXEMPTIONS.] (a) Multiline telephone systems 
  5.8   with a single emergency response location are exempt from the 
  5.9   signaling and database maintenance regulations.  Requirements 
  5.10  for multiline telephone system operators and wireless multiline 
  5.11  telephone system operators to provide dialing instructions still 
  5.12  apply.  
  5.13     (b) Multiline telephone system operators that employ 
  5.14  alternative methods of enhanced 911 support are exempt from the 
  5.15  signaling and database maintenance regulations.  
  5.16     (c) A multiline telephone system operator may apply for an 
  5.17  exemption from the requirements in this section from the chief 
  5.18  officer of each public safety answering point serving that 
  5.19  jurisdiction. 
  5.20     Subd. 6.  [APPLICABILITY.] The requirements of subdivisions 
  5.21  3 and 4 apply to multiline telephone systems installed after 
  5.22  December 31, 2004.  The requirements of subdivisions 1 and 2 and 
  5.23  the exemptions in subdivision 5 apply regardless of when the 
  5.24  multiline telephone system was installed. 
  5.25     Sec. 9.  [EFFECTIVE DATE.] 
  5.26     Sections 1 to 8 are effective the day following final 
  5.27  enactment.
