  1.1                          A bill for an act 
  1.2             relating to liquor; authorizing the city of 
  1.3             Minneapolis to issue an on-sale wine and malt liquor 
  1.4             license for the Illusion Theatre and the Hollywood 
  1.5             Theatre; authorizing winemaking on premises stores; 
  1.6             authorizing the city of St. Paul to issue an on-sale 
  1.7             wine and malt liquor license to the Great American 
  1.8             History Theater; exempting an on-sale intoxicating 
  1.9             liquor license in Bemidji from statutory restrictions 
  1.10            on proximity to a state university; authorizing the 
  1.11            cities of Duluth, Springfield, and Eveleth, to issue 
  1.12            on-sale intoxicating liquor licenses; authorizing the 
  1.13            city of Anoka to issue an on-sale wine license; 
  1.14            amending Minnesota Statutes 1999 Supplement, section 
  1.15            340A.404, subdivisions 2 and 2b; Laws 1999, chapter 
  1.16            202, section 15; proposing coding for new law in 
  1.17            Minnesota Statutes, chapter 340A. 
  1.18  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.19     Section 1.  Minnesota Statutes 1999 Supplement, section 
  1.20  340A.404, subdivision 2, is amended to read: 
  1.21     Subd. 2.  [SPECIAL PROVISION; CITY OF MINNEAPOLIS.] (a) The 
  1.22  city of Minneapolis may issue an on-sale intoxicating liquor 
  1.23  license to the Guthrie Theater, the Cricket Theatre, the Orpheum 
  1.24  Theatre, and the State Theatre, notwithstanding the limitations 
  1.25  of law, or local ordinance, or charter provision relating to 
  1.26  zoning or school or church distances.  The licenses authorize 
  1.27  sales on all days of the week to holders of tickets for 
  1.28  performances presented by the theaters and to members of the 
  1.29  nonprofit corporations holding the licenses and to their guests. 
  1.30     (b) The city of Minneapolis may issue an intoxicating 
  1.31  liquor license to 510 Groveland Associates, a Minnesota 
  2.1   cooperative, for use by a restaurant on the premises owned by 
  2.2   510 Groveland Associates, notwithstanding limitations of law, or 
  2.3   local ordinance, or charter provision. 
  2.4      (c) The city of Minneapolis may issue an on-sale 
  2.5   intoxicating liquor license to Zuhrah Shrine Temple for use on 
  2.6   the premises owned by Zuhrah Shrine Temple at 2540 Park Avenue 
  2.7   South in Minneapolis, notwithstanding limitations of law, or 
  2.8   local ordinances, or charter provision relating to zoning or 
  2.9   school or church distances. 
  2.10     (d) The city of Minneapolis may issue an on-sale 
  2.11  intoxicating liquor license to the American Association of 
  2.12  University Women, Minneapolis branch, for use on the premises 
  2.13  owned by the American Association of University Women, 
  2.14  Minneapolis branch, at 2115 Stevens Avenue South in Minneapolis, 
  2.15  notwithstanding limitations of law, or local ordinances, or 
  2.16  charter provisions relating to zoning or school or church 
  2.17  distances. 
  2.18     (e) The city of Minneapolis may issue an on-sale wine 
  2.19  license and an on-sale 3.2 percent malt liquor license to a 
  2.20  restaurant located at 5000 Penn Avenue South, and an on-sale 
  2.21  wine license and an on-sale malt liquor license to a restaurant 
  2.22  located at 1931 Nicollet Avenue South, notwithstanding any law 
  2.23  or local ordinance or charter provision. 
  2.24     (f) The city of Minneapolis may issue an on-sale wine 
  2.25  license and an on-sale malt liquor license to the Brave New 
  2.26  Workshop Theatre located at 3001 Hennepin Avenue South, and to 
  2.27  the Theatre de la Jeune Lune, the Illusion Theatre located at 
  2.28  528 Hennepin Avenue South, and the Hollywood Theatre located at 
  2.29  2815 Johnson Street Northeast, notwithstanding any law or local 
  2.30  ordinance or charter provision.  The license authorizes sales on 
  2.31  all days of the week. 
  2.32     (g) The city of Minneapolis may issue an on-sale 
  2.33  intoxicating liquor license to University Gateway Corporation, a 
  2.34  Minnesota nonprofit corporation, for use by a restaurant or 
  2.35  catering operator at the building owned and operated by the 
  2.36  University Gateway Corporation on the University of Minnesota 
  3.1   campus, notwithstanding limitations of law, or local ordinance 
  3.2   or charter provision.  The license authorizes sales on all days 
  3.3   of the week. 
  3.4      Sec. 2.  [340A.34] [WINEMAKING ON PREMISES STORE.] 
  3.5      A commercial establishment in which individuals make wine 
  3.6   on the premises for personal and family use only and not for 
  3.7   resale, using ingredients or materials or both supplied by the 
  3.8   establishment, is not required to be licensed under this chapter 
  3.9   if the establishment is operated in accordance with Code of 
  3.10  Federal Regulations, title 27, section 24.75.  No person under 
  3.11  the age of 21 years may participate in the making of wine in 
  3.12  such an establishment.  Alcoholic beverages may not be sold or 
  3.13  otherwise provided to customers of an establishment described in 
  3.14  this section unless the establishment holds the appropriate 
  3.15  license for such sale or provision. 
  3.16     Sec. 3.  Minnesota Statutes 1999 Supplement, section 
  3.17  340A.404, subdivision 2b, is amended to read: 
  3.18     Subd. 2b.  [SPECIAL PROVISION; CITY OF ST. PAUL.] The city 
  3.19  of St. Paul may issue an on-sale intoxicating liquor license to 
  3.20  the Fitzgerald Theatre, and an on-sale wine and on-sale malt 
  3.21  liquor license to the Great American History Theater at 30 East 
  3.22  10th Street, notwithstanding the limitations of law, or local 
  3.23  ordinance, or charter provision relating to zoning or school or 
  3.24  church distances.  The license authorizes sales on all days of 
  3.25  the week to holders of tickets for performances presented by the 
  3.26  theatre and to members of the nonprofit corporation holding the 
  3.27  license and to their guests. 
  3.28     Sec. 4.  Laws 1999, chapter 202, section 15, is amended to 
  3.29  read: 
  3.30     Sec. 15.  [CITY OF BEMIDJI; LIQUOR LICENSE.] 
  3.31     The city of Bemidji may issue one on-sale intoxicating 
  3.32  liquor license in addition to the number authorized by law.  All 
  3.33  provisions of Minnesota Statutes, chapter 340A, not inconsistent 
  3.34  with this section, other than Minnesota Statutes, section 
  3.35  340A.412, subdivision 4, clause (8), apply to the licenses 
  3.36  license authorized under this section. 
  4.1      Sec. 5.  [CITY OF DULUTH; LAKE SUPERIOR CENTER AUTHORITY.] 
  4.2      Notwithstanding any law, ordinance, or charter provision to 
  4.3   the contrary, the city of Duluth may issue an on-sale 
  4.4   intoxicating liquor license to the Lake Superior Center 
  4.5   Authority for certain events at the Lake Superior Center.  The 
  4.6   license shall limit the sale of intoxicating liquor to persons 
  4.7   leasing space in the Lake Superior Center and their guests for 
  4.8   the purpose of conducting any convention, banquet, conference, 
  4.9   meeting, or social affair.  The fee for the license shall be set 
  4.10  by the Duluth city council.  The license must be issued in 
  4.11  accordance with laws governing issuance of on-sale intoxicating 
  4.12  liquor licenses in cities of the first class not inconsistent 
  4.13  with this section and with city charter provisions and 
  4.14  ordinances not inconsistent with this section. 
  4.15     Sec. 6.  [CITY OF SPRINGFIELD; AUTHORIZATION.] 
  4.16     The city of Springfield may authorize a holder of a retail 
  4.17  on-sale intoxicating liquor license issued by the city to 
  4.18  dispense intoxicating liquor at an event on December 31, 2000, 
  4.19  and January 1, 2001, at a facility owned by the city, 
  4.20  notwithstanding Minnesota Statutes, section 340A.504, 
  4.21  subdivision 3.  All provisions of Minnesota Statutes, section 
  4.22  340A.404, subdivision 4, paragraph (a), apply to the authority 
  4.23  granted under this section. 
  4.24     Sec. 7.  [CITY OF EVELETH; LIQUOR LICENSE.] 
  4.25     Notwithstanding other law, the city of Eveleth may issue 
  4.26  one on-sale intoxicating liquor license to the Quad Cities Joint 
  4.27  Recreational Center Authority.  The Authority may, but shall not 
  4.28  be required to, contract with an independent contractor to 
  4.29  operate the on-sale liquor establishment.  The independent 
  4.30  contractor need not hold a license in its own name.  All 
  4.31  provisions of Minnesota Statutes, chapter 340A, not inconsistent 
  4.32  with this section, apply to the license authorized under this 
  4.33  section. 
  4.34     Sec. 8.  [WINE LICENSE; MAIN STREET STAGE THEATRE.] 
  4.35     The city of Anoka may issue an on-sale wine license to the 
  4.36  Lyric Arts Company of Anoka, Inc. for the Main Street Stage 
  5.1   Theatre.  The license authorizes sales on all days of the week 
  5.2   to holders of tickets for performances at the theater.  All 
  5.3   provisions of Minnesota Statutes, chapter 340A, not inconsistent 
  5.4   with this section apply to the license authorized under this 
  5.5   section. 
  5.6      Sec. 9.  [EFFECTIVE DATES.] 
  5.7      Section 1 is effective on approval by the Minneapolis city 
  5.8   council and compliance with Minnesota Statutes, section 645.021. 
  5.9   Section 2 is effective the day following final enactment.  
  5.10  Section 3 is effective upon approval by the St. Paul city 
  5.11  council and compliance with Minnesota Statutes, section 645.021. 
  5.12  Section 4 is effective on approval by the Bemidji city council 
  5.13  and compliance with Minnesota Statutes, section 645.021.  
  5.14  Section 5 is effective on approval by the Duluth city council 
  5.15  and compliance with Minnesota Statutes, section 645.021.  
  5.16  Section 6 is effective upon approval by the governing body of 
  5.17  Springfield and compliance with Minnesota Statutes, section 
  5.18  645.021.  Section 7 is effective upon approval by the Eveleth 
  5.19  city council and compliance with Minnesota Statutes, section 
  5.20  645.021.  Section 8 is effective on approval by the Anoka city 
  5.21  council and compliance with Minnesota Statutes, section 645.021.
