  1.1                          A bill for an act 
  1.2             relating to manufactured homes; clarifying the 
  1.3             requirements for a limited dealer license; amending 
  1.4             Minnesota Statutes 1998, section 327B.04, subdivision 
  1.5             8.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 327B.04, 
  1.8   subdivision 8, is amended to read: 
  1.9      Subd. 8.  [LIMITED DEALER'S LICENSE.] The commissioner 
  1.10  shall issue a limited dealer's license to an owner of a 
  1.11  manufactured home park authorizing the licensee to engage in the 
  1.12  sale, offering for sale, soliciting, or advertising the sale of 
  1.13  used manufactured homes located in the owned manufactured home 
  1.14  park as principal only.  The licensee must be the title holder 
  1.15  of the homes and may engage in no more than five sales 
  1.16  annually.  An owner may, upon payment of the applicable fee and 
  1.17  compliance with this subdivision, obtain a separate license for 
  1.18  each owned manufactured home park and is entitled to sell up to 
  1.19  five homes per license.  The license shall be issued only after: 
  1.20     (1) receipt of the an application described in section 
  1.21  327B.04, subdivision 3, on forms provided by the commissioner 
  1.22  containing the following information: 
  1.23     (i) proper identification; 
  1.24     (ii) the name under which the applicant will be licensed 
  1.25  and do business in this state; 
  2.1      (iii) the applicant's type and place of business; and 
  2.2      (iv) the name, home, and business address of the applicant; 
  2.3      (2) payment of the a $100 annual fee prescribed in section 
  2.4   327B.04, subdivision 7,; and compliance with the license 
  2.5   prerequisites contained in section 327B.04, subdivision 4; 
  2.6   except that an applicant need only secure 
  2.7      (3) provision of a surety bond in the amount of $5,000, and.
  2.8      The applicant need not comply with section 327B.04, 
  2.9   subdivision 4, paragraph (e).  The holding of a limited dealer's 
  2.10  license does not satisfy the requirement contained in section 
  2.11  327B.04, subdivision 4, paragraph (e), for the licensee or 
  2.12  salespersons with respect to obtaining a dealer license.  The 
  2.13  commissioner may, upon application for a renewal of a license, 
  2.14  require only the following additional information:  
  2.15     (1) a one-page verification that copies of applicable sales 
  2.16  documents have been retained; 
  2.17     (2) sales documents that include the safety feature 
  2.18  disclosure form defined in section 327C.07, subdivision 3a; 
  2.19     (3) title of the home; 
  2.20     (4) financing agreements; and 
  2.21     (5) purchase agreements. 
  2.22     The commissioner shall adopt rules under sections 14.22 to 
  2.23  14.28 to provide for issuing a limited dealer's license. 
  2.24     Sec. 2.  [EFFECTIVE DATE.] 
  2.25     Section 1 is effective the day following final enactment.
