A bill for an act
relating to local government; authorizing counties and cities to exempt land less
than 20 acres from the fence-viewing process; authorizing counties and cities
to adopt fence policies; amending Minnesota Statutes 2014, sections 344.011;
344.20.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 344.011, is amended to read:


344.011 EXEMPTION.

A new text begin county board, home rule charter or statutory city council, or new text end town board may,
by resolution, exempt adjoining owners or occupants from this chapter when their land
considered together is less than 20 acres.

Sec. 2.

Minnesota Statutes 2014, section 344.20, is amended to read:


344.20 new text begin COUNTY, CITY, OR new text end TOWN OPTION.

new text begin (a) new text end If eight or more landowners in a new text begin county, home rule charter or statutory city, or
new text end town petition the deleted text begin town boarddeleted text end new text begin governing bodynew text end for a vote on a partition fence policy, the
deleted text begin town boarddeleted text end new text begin governing bodynew text end may adopt its own policy and procedures for dealing with
partition fences, including enforcement procedures. new text begin When a town board adopts a partition
fence policy,
new text end the policy must be approved by the electors of the town at an annual or
special town meeting, in which case this chapter does not apply in that town.

new text begin (b) new text end This chapter applies to any partition fence lying on the boundary between a deleted text begin town
which
deleted text end new text begin political subdivision that new text end has adopted its own partition fence policy and any other
political subdivision unless the other political subdivision deleted text begin is a town whichdeleted text end has adopted a
similar policy.
