A bill for an act
relating to education; establishing a conflict of interest exception for certain
school contracts for professional and other services; amending Minnesota
Statutes 2006, section 471.88, subdivision 5.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 471.88, subdivision 5, is amended to read:


Subd. 5.

Contract with no bids required.

A contract for which competitive bids
are not required by law.new text begin Among other examples, this exception applies to employment
contracts between a local school board and a class of school district employees such as
teachers or custodians, where the spouse of a school board member is a member of the
class of employees contracting with the school board and the employee spouse receives no
special monetary or other benefit that is substantially different from the benefits that other
members of the class receive under the employment contract. A school board invoking
this exception must have a majority of the disinterested school board members vote to
approve the contract, direct the school board member spouse to abstain from voting to
approve the contract, and publicly set out the essential facts of the contract at the meeting
where the contract is approved.
