  1.1                          A bill for an act 
  1.2             relating to historical preservation; ensuring 
  1.3             protection for the historic Camp Coldwater Springs 
  1.4             area; proposing coding for new law in Minnesota 
  1.5             Statutes, chapter 138. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [138.767] [COLDWATER SPRINGS.] 
  1.8      Subdivision 1.  [PURPOSE.] This act preserves in perpetuity 
  1.9   27.3 acres of land known as historic Camp Coldwater, Coldwater 
  1.10  Springs, as the birthplace of Minnesota, and as a sacred origin 
  1.11  site of the Dakota Nation.  Since 1805, these lands were part of 
  1.12  a United States military reserve, later Fort Snelling Military 
  1.13  Reserve, and formerly were used by the Bureau of Mines. 
  1.14     Subd. 2.  [RECOGNITION; PRESERVATION.] The state recognizes 
  1.15  the 27.3 acres of land in Hennepin county, comprising and 
  1.16  surrounding historic Camp Coldwater Springs, as a traditional 
  1.17  cultural property, which is entitled to preservation and 
  1.18  protection by the state historic preservation office, and by 
  1.19  other state and local public agencies.  The state, the 
  1.20  University of Minnesota, or any city, county, town, unit of 
  1.21  metropolitan government, or other political subdivision of the 
  1.22  state may not use the land or take any action that affects the 
  1.23  land unless the use or action: 
  1.24     (1) complies with United State Code, title 25, sections 32 
  1.25  and 3001 et seq.; and 
  2.1      (2) does not affect the current flow of water to or from 
  2.2   Camp Coldwater Springs and does not otherwise significantly 
  2.3   impact the natural communities in and around the springs.  
  2.4      Sec. 2.  [EFFECTIVE DATE.] 
  2.5      Section 1 is effective the day following final enactment 
  2.6   and applies to uses or actions taken after that date.
