1.1A bill for an act
1.2relating to health professions; allowing the return of drugs dispensed by
1.3pharmacies in certain circumstances; assuring certification of prescriptions;
1.4proposing coding for new law in Minnesota Statutes, chapter 151.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [151.56] COUNTY RETURN OF UNUSED DRUGS OR MEDICAL
1.7DEVICES.
1.8Notwithstanding Minnesota Rules, part 6800.2700, pharmacies may accept returns
1.9of unused drugs and medical devices from county jails and juvenile correctional facilities.
1.10In order to return unused drugs and medical devices, the county jail or juvenile correctional
1.11facility must have a trained medication technician on hand twenty-four hours a day, seven
1.12days a week and the medication must be stored in a secured locked storage locker.

1.13    Sec. 2. CERTIFICATION OF PRESCRIPTIONS.
1.14    The Board of Pharmacy shall require a pharmacist or pharmacist intern at the
1.15pharmacy that dispenses, delivers, mails, or ships a completed prescription to the patient
1.16to be responsible for assuring that the prescription has been certified prior to completion of
1.17the transaction. The pharmacist or pharmacist intern at the pharmacy is not required to
1.18directly certify the prescription, if certification has been completed at another pharmacy.
