  1.1                          A bill for an act
  1.2             relating to employment; permitting employers of 
  1.3             professional athletes to request or require random 
  1.4             drug testing for the presence of anabolic steroids; 
  1.5             amending Minnesota Statutes, section 181.951, 
  1.6             subdivision 4. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2004, section 181.951, 
  1.9   subdivision 4, is amended to read: 
  1.10     Subd. 4.  [RANDOM TESTING.] An employer may request or 
  1.11  require only employees in safety-sensitive positions to undergo 
  1.12  drug and alcohol testing on a random selection basis only if (1) 
  1.13  they are employed in safety-sensitive positions, or (2) they are 
  1.14  employed as professional athletes if the professional athlete is 
  1.15  subject to a collective bargaining agreement permitting random 
  1.16  testing but only to the extent consistent with the collective 
  1.17  bargaining agreement.  
  1.18     [EFFECTIVE DATE.] This section is effective the day 
  1.19  following final enactment.
