  1.1                          A bill for an act 
  1.2             relating to health; modifying the definition of 
  1.3             practice of pharmacy; defining patient counseling; 
  1.4             amending Minnesota Statutes 1998, section 151.01, 
  1.5             subdivision 27, and by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 151.01, 
  1.8   subdivision 27, is amended to read: 
  1.9      Subd. 27.  [PRACTICE OF PHARMACY.] "Practice of pharmacy" 
  1.10  means: 
  1.11     (1) the interpretation and evaluation of prescriptions 
  1.12  or prescription drug orders and orders affecting drug therapy; 
  1.13     (2) the compounding, labeling, and dispensing, or labeling 
  1.14  of drugs and devices (except labeling by a manufacturer or 
  1.15  packager of nonprescription drugs or commercially packaged 
  1.16  legend drugs and devices); 
  1.17     (3) the provision of patient counseling regarding drug 
  1.18  therapy; 
  1.19     (4) participation in clinical interpretations and 
  1.20  monitoring of drug therapy for assurance of safe and effective 
  1.21  use of drugs; 
  1.22     (4) (5) participation in drug and therapeutic device 
  1.23  selection and; drug administration for first dosage, 
  1.24  immunizations, and emergencies; drug utilization regimen 
  1.25  reviews; and drug or drug-related research; 
  2.1      (5) (6) participation in the practice of managing drug 
  2.2   therapy and modifying drug therapy according to written 
  2.3   protocols with a practitioner authorized to independently 
  2.4   prescribe drugs; 
  2.5      (7) participation in the storage of drugs and the 
  2.6   maintenance of records therefor; 
  2.7      (6) the (8) responsibility for advising on therapeutic 
  2.8   values, content, hazards, and uses of drugs and devices; and 
  2.9      (7) the (9) offering or performing of those acts, services, 
  2.10  operations, or transactions necessary in the conduct, operation, 
  2.11  management, and control of a pharmacy. 
  2.12     Sec. 2.  Minnesota Statutes 1998, section 151.01, is 
  2.13  amended by adding a subdivision to read: 
  2.14     Subd. 31.  [PATIENT COUNSELING.] "Patient counseling" means 
  2.15  pharmacist counseling according to the counseling requirement as 
  2.16  defined under the federal Omnibus Budget Reconciliation Act of 
  2.17  1990, Statutes at Large, volume 104, page 1388.
