  1.1                          A bill for an act 
  1.2             relating to state government; abolishing the 
  1.3             department of employee relations; transferring duties; 
  1.4             repealing Minnesota Statutes 2000, sections 43A.03; 
  1.5             176.5401. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1. [ABOLITION OF DEPARTMENT; TRANSFER OF DUTIES.] 
  1.8      The department of employee relations is abolished.  All of 
  1.9   the powers, rights, responsibilities, and duties of the 
  1.10  department with respect to the compensation and the terms and 
  1.11  conditions of employment of state employees are transferred to 
  1.12  the department of labor and industry.  All of the powers, 
  1.13  rights, responsibilities, and duties of the department with 
  1.14  respect to employee health plans are transferred to the 
  1.15  department of health.  All remaining powers, rights, 
  1.16  responsibilities, and duties of the department are transferred 
  1.17  to the department of administration.  The transfer is governed 
  1.18  by Minnesota Statutes, section 15.039, except that the positions 
  1.19  of commissioner, deputy commissioner, and assistant 
  1.20  commissioners of employee relations are abolished. 
  1.21     Sec. 2.  [REVISOR INSTRUCTION.] 
  1.22     (a) The revisor of statutes shall change references in the 
  1.23  following sections of Minnesota Statutes from the commissioner 
  1.24  or department of employee relations to the commissioner or 
  1.25  department of labor and industry, and shall make conforming 
  2.1   changes as appropriate:  4.46; 6.582; 13.67; 13.6705; 15.053;

  2.13     (b) The revisor of statutes shall change references in the 
  2.14  following sections of Minnesota Statutes from the commissioner 
  2.15  or department of employee relations to the commissioner or 
  2.16  department of health, and shall make conforming changes as 
  2.17  appropriate:  15.46; 43A.22; 43A.23; 43A.24; 43A.26 43A.27; 
  2.18  43A.28; 43A.29; 43A.30; 43A.31; 43A.316; 43A.317; 43A.318; 
  2.19  62D.145, subdivision 2, clause (7); 62I.121; 116O.04; 116S.03; 
  2.20  176.572; and 256B.0644. 
  2.21     (c) The revisor of statutes shall change the reference in 
  2.22  Minnesota Statutes, section 43A.04, subdivision 11, from 
  2.23  "commissioner" to "commissioner of administration." 
  2.24     (d) The revisor of statutes shall delete references to the 
  2.25  commissioner or department of employee relations in the 
  2.26  following sections of Minnesota Statutes, and shall make 
  2.27  conforming changes as appropriate:  14.3691; 15.01; 15.06; 
  2.28  15A.0815; 43A.08, subdivision 1a; 62J.451; and 144.70. 
  2.29     (e) The revisor of statutes shall change references in 
  2.30  Minnesota Rules as appropriate to conform to paragraphs (a) to 
  2.31  (d). 
  2.32     Sec. 3.  [REPEALER.] 
  2.33     Minnesota Statutes 2000, sections 43A.03, and 176.5401, are 
  2.34  repealed. 
  2.35     Sec. 4.  [EFFECTIVE DATE.] 
  2.36     Sections 1 to 3 are effective July 1, 2002.
