A bill for an act
relating to state government; creating employment guidance for using bond
proceeds; requiring reports.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin APPLICABLE MINNESOTA STATUTES AND ADMINISTRATIVE
RULES.

new text begin Appropriations of bond proceeds shall, to the extent practicable, be subject to
Minnesota Statutes, sections 16C.16, subdivisions 4 to 7, except that subdivision 12 does
not apply; 363A.36; and 363A.37; and Minnesota Rules, parts 5000.3535 and 5000.3600.

Sec. 2. new text begin GUIDANCE FOR COMPLIANCE WITH MINNESOTA STATUTES
AND ADMINISTRATIVE RULES.

new text begin State agencies, local governments, and other entities receiving bond proceeds shall,
in the expenditure of these proceeds, require as part of any bid or proposal for a contract or
agreement from any business, a plan to:

new text begin (1) recruit individuals to perform work who are unemployed, especially targeting
communities experiencing disproportionately high rates of unemployment including, but
not limited to, low-income, rural, and tribal communities and communities of color;
new text end

new text begin (2) recruit individuals to perform work from available training providers, including,
but not limited to, opportunities industrialization centers, skilled trades labor unions, tribal
colleges or nonprofits working in tribal communities, community action partnerships, and
nonprofit organizations providing pertinent job training;

new text begin (3) disseminate information about subcontract and employment opportunities
generated by bond proceeds to disadvantaged groups, including, but not limited to,
low-income, rural, and tribal communities and communities of color; and

new text begin (4) for building construction, renewal, and renovation projects, demonstrate the total
calculated and document the actual calculated energy savings created by the project.

Sec. 3. new text begin REPORTING REQUIREMENTS.

new text begin State agencies, local governments, and other entities receiving bond proceeds shall
report to the house of representatives and senate committees with jurisdiction over their
appropriation of bond proceeds a complete accounting of the following:

new text begin (1) within six months of the awarding of project contracts, and every six months
thereafter until the completion of a project, the number of jobs created and retained by the
project, and the total number of hours worked by individuals from low-income, rural, and
tribal communities and communities of color;

new text begin (2) within six months of the awarding of project contracts, and every six months
thereafter until the completion of a project, the number of workers recruited from available
apprentice and training programs, including the name and location of the program, total
number of hours worked, and length of job retention;

new text begin (3) within six months of the awarding of project contracts, a detailed description of
contract and employment information dissemination efforts to disadvantaged groups;

new text begin (4) within six months of the completion of building construction, renovation, and
renewal projects, the total calculated and actual energy savings for the project; and

new text begin (5) within six months of the awarding of project contracts, and every six months
thereafter until the completion of a project, compliance with sections 16C.16, subdivisions
4 to 7; 363A.36; and 363A.37; and Minnesota Rules, parts 5000.3535 and 5000.3600.
