  1.1                          A bill for an act 
  1.2             relating to child care; removing a sunset provision; 
  1.3             amending Minnesota Statutes 2000, section 245A.14, 
  1.4             subdivision 8.  
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2000, section 245A.14, 
  1.7   subdivision 8, is amended to read: 
  1.8      Subd. 8.  [EXPERIENCED AIDES; CHILD CARE CENTERS.] (a) An 
  1.9   individual employed as an aide at a child care center may work 
  1.10  with children without being directly supervised for up to 25 
  1.11  percent of the individual's daily work shift if: 
  1.12     (1) a teacher is in the building; 
  1.13     (2) the individual has received first aid training within 
  1.14  the last three years; and 
  1.15     (3) the individual is at least 20 years old and has at 
  1.16  least 4,160 hours of child care experience as defined in section 
  1.17  245A.02, subdivision 6b. 
  1.18     (b) The use of an experienced aide working without direct 
  1.19  supervision under paragraph (a) is limited to 25 percent of each 
  1.20  classroom's daily hours of operation. 
  1.21     (c) A child care center that uses experienced aides under 
  1.22  this subdivision must notify the commissioner once per year.  
  1.23  The notification must indicate the approximate number of hours 
  1.24  per classroom per month that this subdivision is used.  Upon 
  1.25  enrollment and once each year, child care centers must report to 
  2.1   parents or guardians if they use experienced aides under this 
  2.2   subdivision. 
  2.3      (d) This subdivision sunsets June 30, 2003.
