A bill for an act
relating to human services; extending and modifying eligibility for the COBRA
premium state subsidy; amending Laws 2009, chapter 79, article 5, section 78,
subdivisions 1, 5.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Laws 2009, chapter 79, article 5, section 78, subdivision 1, is amended to
read:


Subdivision 1.

Eligibility.

(a) An individual and the individual's qualified
beneficiaries shall be eligible for a state premium subsidy equal to 35 percent of the
premiums the individual is required to pay for the continuation of health care coverage
under COBRA, if the individual and the individual's qualified beneficiaries:

(1) are eligible for the 65 percent COBRA continuation premium subsidy for health
care coverage under the American Recovery and Reinvestment Act of 2009new text begin or the
Department of Defense Appropriations Act, 2010, Public Law 111-118
new text end ;

(2) elect COBRA continuation health care coverage; and

(3) are eligible for medical assistance under Minnesota Statutes, chapter 256B;
general assistance medical care under Minnesota Statutes, section 256D.03; new text begin temporary
general assistance medical care;
new text end or MinnesotaCare under Minnesota Statutes, chapter
256L, except for the four-month barrier requirement under Minnesota Statutes, section
256L.07, subdivision 3.

(b) Eligibility for the state subsidy shall continue for as long as the individual
remains eligible for the COBRA premium subsidies provided under the American
Recovery and Reinvestment Act of 2009new text begin or the Department of Defense Appropriations
Act, 2010, Public Law 111-118

Sec. 2.

Laws 2009, chapter 79, article 5, section 78, subdivision 5, is amended to read:

Expiration.
