A bill for an act
 relating to transportation; requiring a waiver request concerning the federal
Disadvantaged Business Enterprise program.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin WAIVER; DISADVANTAGED BUSINESS ENTERPRISE PROGRAM.

new text begin (a) By October 1, 2016, the commissioner of transportation must submit to the
United States Department of Transportation, Federal Highway Administration, a request
under Code of Federal Regulations, title 49, section 26.15, for a waiver from the
requirements of the federal Disadvantaged Business Enterprise program. The waiver
request must seek establishment of separate participation goals for disadvantaged
business enterprises at least 51 percent owned by the following socially and economically
disadvantaged individuals: (1) women; and (2) all other individuals meeting the definition.

individual" has the meaning given in Code of Federal Regulations, title 49, section 26.5.
