  1.1                          A bill for an act 
  1.2             relating to claims against the state; providing for 
  1.3             settlement of various claims; appropriating money. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [DEPARTMENT OF CORRECTIONS.] 
  1.6      The amounts in this section are appropriated from the 
  1.7   general fund to the commissioner of corrections in fiscal year 
  1.8   2005 as full and final payment under Minnesota Statutes, section 
  1.9   3.739, of claims against the state for injuries suffered by and 
  1.10  medical services provided to individuals who were injured while 
  1.11  performing community service or sentencing-to-service work for 
  1.12  correctional purposes. 
  1.13     (a) For claims already paid by the department, $........ 
  1.14     (b) For payment to William Brown for a permanent partial 
  1.15  disability suffered while performing community service work in 
  1.16  Carlton County, $35,090. 
  1.17     (c) For payment to Steven Rosoff for a permanent partial 
  1.18  disability suffered while performing sentencing-to-service work 
  1.19  in Hennepin County, $9,350. 
  1.20     Sec. 2.  [DEPARTMENT OF NATURAL RESOURCES.] 
  1.21     Subdivision 1.  [BODE CLAIM.] (a) The Department of Natural 
  1.22  Resources shall pay from its existing appropriation the amount 
  1.23  required to restore tiling on the farm of Linda and Judy Bode in 
  1.24  Nicollet, Minnesota, that was destroyed by the department in 
  2.1   1992 and 1993, as a full and final settlement of their claim 
  2.2   against the state.  The payment must be no more than $26,000. 
  2.3      (b) As determined by the Nicollet County Hearings Unit in 
  2.4   1980, the wetlands on the Bode farm is separate from the 
  2.5   wetlands on the neighboring farm and is less than ten acres in 
  2.6   size. 
  2.7      Subd. 2.  [PETTY CLAIM.] $38,118.57 is appropriated from 
  2.8   the general fund to the commissioner of natural resources in 
  2.9   fiscal year 2005 for payment to Petty and Sons Timber Products, 
  2.10  Inc. of Wahkon, Minnesota, as a full and final settlement of its 
  2.11  claim against the state for losses suffered because of a 
  2.12  moratorium imposed on raising logs from Minnesota lake bottoms. 
  2.13     Subd. 3.  [SHOEN CLAIM.] $1,353.26 is appropriated from the 
  2.14  general fund to the commissioner of natural resources in fiscal 
  2.15  year 2005 for payment to Samuel and June Shoen of Angle Inlet, 
  2.16  Minnesota, as a full and final settlement of their claim against 
  2.17  the state for reimbursement of trespass fines paid during 
  2.18  settlement of a land exchange.
