1.1 A bill for an act 1.2 relating to education; modifying the membership of the 1.3 Commission on National and Community Service; amending 1.4 Minnesota Statutes 2003 Supplement, section 124D.385, 1.5 subdivision 2; repealing Minnesota Statutes 2002, 1.6 sections 124D.41; 124D.42, subdivisions 1, 2, 4, 5, 7; 1.7 124D.43; Minnesota Statutes 2003 Supplement, section 1.8 124D.42, subdivisions 3, 6. 1.9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.10 Section 1. Minnesota Statutes 2003 Supplement, section 1.11 124D.385, subdivision 2, is amended to read: 1.12 Subd. 2. [MEMBERSHIP.] (a) The commission consists of 1.131825 voting members. Voting members shall include the 1.14 commissioner of education, a representative of the Children's1.15Cabinet elected by the members of the Children's Cabinet, and1.16the executive director of the Higher Education Services Office. 1.17 (b) The governor shall appoint15eight additional voting 1.18 members. Eight of the voting members appointed by the governor1.19shallthat include a representative ofpublic or nonprofit1.20 organizations experienced in youth employment and training, 1.21 organizations promoting adult service and volunteerism, 1.22 community-based service agencies or organizations, local public 1.23 or private sector labor unions, local governments, business, a 1.24 national service program, andIndian tribesan individual 1.25 between the ages of 16 and 25 who is a participant or supervisor 1.26 in a program. The remainingseven16 voting members appointed 1.27 by the governor shall includean individualindividuals with 2.1 expertise in theeducational, training, and development needs of2.2youth, particularly disadvantaged youth; a youth or young adult2.3who is a participant in a higher education-based2.4service-learning program; a disabled individual representing2.5persons with disabilities; a youth who is out-of-school or2.6disadvantaged; an educator of primary or secondary students; an2.7educator from a higher education institution; and an individual2.8between the ages of 16 and 25 who is a participant or supervisor2.9in a youth service programmanagement and operations of a 2.10 nonprofit organization, including individuals with expertise in 2.11 public relations, finance, and development. 2.12 (c) The governor shall appoint up to five ex officio 2.13 nonvoting members fromamong the following agencies or2.14organizations: the Departments of Economic Security, Natural2.15Resources, Human Services, Health, Corrections, Agriculture,2.16Public Safety, Finance, and Labor and Industry, the Housing2.17Finance Agency, and Minnesota Technology, Incappropriate state 2.18 agencies. A representative of the Corporation for National and 2.19 Community Service shall also serve as an ex officio nonvoting 2.20 member. 2.21 (d) Voting and ex officio nonvoting members may appoint 2.22 designees to act on their behalf. The number of voting members 2.23 who are state employees shall not exceed 25 percent. 2.24 (e) The governor shall ensure that, to the extent possible, 2.25 the membership of the commission is balanced according to 2.26 geography, race, ethnicity, age, and gender. The speaker of the 2.27 house and the majority leader of the senate shall each appoint 2.28 two legislators to be nonvoting members of the commission. 2.29 Sec. 2. [REPEALER.] 2.30 (a) Minnesota Statutes 2002, sections 124D.41; 124D.42, 2.31 subdivisions 1, 2, 4, 5, and 7; and 124D.43, are repealed. 2.32 (b) Minnesota Statutes 2003 Supplement, section 124D.42, 2.33 subdivisions 3 and 6, are repealed.
