  1.1                          A bill for an act 
  1.2             relating to employment; regulating vocational 
  1.3             rehabilitation and supported employment; expanding 
  1.4             what activities qualify as supported employment; 
  1.5             amending Minnesota Statutes 2002, section 268A.01, 
  1.6             subdivision 13. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 268A.01, 
  1.9   subdivision 13, is amended to read: 
  1.10     Subd. 13.  [SUPPORTED EMPLOYMENT.] "Supported employment" 
  1.11  means employment of a person with a disability so severe that 
  1.12  the person needs ongoing training and support to get and keep a 
  1.13  job.  The employment must satisfy the requirement of either 
  1.14  paragraph (a) or (b).  
  1.15     (a) The employment consists of a job in which: 
  1.16     (1) the person engages in paid work in a position removed 
  1.17  from the service vendor's site where individuals without 
  1.18  disabilities who do not require public subsidies also may be 
  1.19  employed; 
  1.20     (2) public funds are necessary to provide ongoing training 
  1.21  and support services throughout the period of the person's 
  1.22  employment; and 
  1.23     (3) the person has the opportunity for social interaction 
  1.24  with individuals who do not have disabilities and who are not 
  1.25  paid caregivers. 
  1.26     (b) The employment consists of a job: 
  2.1      (1) for which the person is paid wages at or above minimum 
  2.2   wage; 
  2.3      (2) at a business where individuals without disabilities 
  2.4   are also employed; and 
  2.5      (3) the person has the opportunity for social interaction 
  2.6   with individuals without disabilities who are not paid 
  2.7   caregivers.
