A bill for an act
relating to environment; prohibiting the use of coal tar; requiring notification and
planning; appropriating money; proposing coding for new law in Minnesota
Statutes, chapter 116.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin A state agency may not purchase a coal tar pavement product. For the purposes of
this section "coal tar pavement product" means a material that contains coal tar and is for
use on an asphalt or concrete surface, including a driveway or parking lot.

Sec. 2. new text begin COAL TAR NOTIFICATION AND REPORT.

new text begin By November 1, 2009, the commissioner of the Pollution Control Agency shall
notify state agencies and local units of government of the potential for contamination
of stormwater ponds with polycyclic aromatic hydrocarbons from the use of coal tar
pavement products. By January 15, 2010, state agencies and local units of government
shall report to the commissioner of the Pollution Control Agency the total number of
stormwater ponds under the jurisdiction of the agency or local unit of government and, of
that total, the number that are contaminated with polycyclic aromatic hydrocarbons. By
July 1, 2010, the commissioner shall develop cost-effective strategies for state agencies
and local units of government to use in cleaning up contaminated stormwater ponds.

Pollution Control Agency to meet the coal tar notification and stormwater pond clean up
planning requirements under section 2 in order to restore and protect water quality.
