1.1CONFERENCE COMMITTEE REPORT ON H. F. No. 1974
1.2A bill for an act
1.3relating to public employment; providing that certain contract terms do not
1.4continue in effect after expiration of a collective bargaining agreement;
1.5amending Minnesota Statutes 2010, section 179A.20, subdivision 6, by adding a
1.6subdivision.

1.12We, the undersigned conferees for H. F. No. 1974 report that we have agreed upon
1.13the items in dispute and recommend as follows:
1.14That the Senate recede from its amendment and that H. F. No. 1974 be further
1.15amended as follows:
1.16Delete everything after the enacting clause and insert:

1.17    "Section 1. Minnesota Statutes 2010, section 179A.20, subdivision 6, is amended to
1.18read:
1.19    Subd. 6. Contract in effect. (a) During the period after contract expiration and prior
1.20to the date when the right to strike matures, and for additional time if the parties agree, the
1.21terms of an existing contract shall continue in effect and shall be enforceable upon both
1.22parties, except as provided in paragraph (b).
1.23(b) A contract term does not continue in effect and is not enforceable after the
1.24expiration date stated in the contract, and the parties may not agree to extend or honor a
1.25contract term beyond the expiration date of the contract if the contract term would:
1.26(1) provide a wage or salary increase to an employee, including but not limited to
1.27an increase based on cost of living, longevity, education or training, or performance or
1.28merit; or
1.29(2) provide an increase in the dollar amount of an employer contribution for
1.30insurance benefits above the amount paid under the expired contract.
2.1(c) Paragraph (b) does not apply to the state employee law enforcement unit, the
2.2state employee correctional guards unit, the University of Minnesota law enforcement
2.3unit, or to other firefighters, peace officers subject to licensure under sections 626.84 to
2.4626.863, or guards at correctional facilities.
2.5EFFECTIVE DATE.This section is effective the day following final enactment.
2.6For a collective bargaining agreement that expired before the effective date of this section,
2.7the requirements of this section apply to limit wages and benefits to the levels and amounts
2.8in effect on the effective date of this section."
