  1.1                          A bill for an act 
  1.2             relating to human services; establishing the Medicare 
  1.3             payment rate as the rate for all nursing facility 
  1.4             residents for the first 90 days following admission; 
  1.5             appropriating money; amending Minnesota Statutes 2000, 
  1.6             section 256B.431, by adding a subdivision; repealing 
  1.7             Minnesota Statutes 2000, section 256B.434, subdivision 
  1.8             5. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2000, section 256B.431, is 
  1.11  amended by adding a subdivision to read: 
  1.12     Subd. 31.  [PAYMENT DURING FIRST 90 DAYS.] (a) For rate 
  1.13  years beginning on or after July 1, 2001, the total payment rate 
  1.14  for a facility reimbursed under this section, section 256B.434, 
  1.15  or any other section for the first 90 days after admission shall 
  1.16  be: 
  1.17     (1) for days one to 30, the rate shall be 120 percent of 
  1.18  the facility's medical assistance rate for each case mix class; 
  1.19  and 
  1.20     (2) for days 31 to 90, the rate shall be 110 percent of the 
  1.21  facility's medical assistance rate for each case mix class. 
  1.22     (b) Beginning with day 91 after admission, the payment rate 
  1.23  shall be the rate otherwise determined under this section, 
  1.24  section 256B.434, or any other section. 
  1.25     (c) This subdivision applies to admissions occurring on or 
  1.26  after July 1, 2001. 
  1.27     Sec. 2.  [APPROPRIATION.] 
  2.1      $....... is appropriated from the general fund to the 
  2.2   commissioner of human services for the biennium beginning July 
  2.3   1, 2001, for the purposes of section 1. 
  2.4      Sec. 3.  [REPEALER.] 
  2.5      Minnesota Statutes 2000, section 256B.434, subdivision 5, 
  2.6   is repealed.
