  1.1                          A bill for an act
  1.2             relating to food safety; authorizing the sale of 
  1.3             certain home-canned foods at farmers' markets and 
  1.4             similar venues; requiring a disclosure statement and 
  1.5             labeling; amending Minnesota Statutes 2002, section 
  1.6             28A.15, by adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 28A.15, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 10.  [HOME-PROCESSED AND HOME-CANNED FRUIT AND 
  1.11  VEGETABLES.] A person who receives less than $5,000 in gross 
  1.12  receipts in a calendar year from the sale of home-processed and 
  1.13  home-canned pickles, vegetables, or fruits prepared by the 
  1.14  person and sold by the person at a community or social event, 
  1.15  farmers' market, roadside stand, or other venue.  If the 
  1.16  processed and canned foods are not prepared in a kitchen that is 
  1.17  licensed or inspected, the seller must post a sign or placard 
  1.18  stating that:  "These canned goods are homemade and not subject 
  1.19  to state inspection."  Each container sold under this 
  1.20  subdivision must be accurately labeled to reflect the name and 
  1.21  address of the person who processed and canned the goods and the 
  1.22  date on which the goods were processed and canned.
