     124.19 Requirements for aid generally.

    Subd. 3.    Unlicensed teachers; aid reduction.  When a 
 district employs one or more teachers who do not hold a valid 
 teaching license, state aid shall be withheld in the proportion 
 that the number of such teachers is to the total number of 
 teachers employed by the district, multiplied by 60 percent of 
 the basic revenue, as defined in section 124A.22, subdivision 2, 
 of the district for the year in which the employment occurred. 

    Subd. 4.  In a school where the number of instructional 
 hours in the school day is greater than the number of 
 instructional hours prescribed in the rules of the state board 
 for the school day, the excess number of instructional hours for 
 those days may be included in calculating the required number of 
 days school is in session for purposes of fulfilling the 
 requirements of subdivision 1, provided that no instructional 
 hours are included from half-day sessions or any school day 
 which has less instructional hours than the number of 
 instructional hours prescribed in the rules of the state board 
 unless the average number of instructional hours for all school 
 days in the school year equals or exceeds the number of 
 instructional hours prescribed in the rules of the state board.  
 The district shall notify the department of each adjustment.  

    Subd. 5.    Schedule adjustments.  (a) It is the 
 intention of the legislature to encourage efficient and 
 effective use of staff and facilities by school districts.  
 School districts are encouraged to consider both cost and energy 
 saving measures.  

    (b) Notwithstanding the provisions of subdivision 1 or 4, 
 any district operating a program pursuant to sections 120.59 to 
 120.67, 121.585 or 125.701 to 125.705, or operating a 
 commissioner-designated area learning center program under 
 section 124C.49, or that otherwise receives the approval of the 
 commissioner to operate its instructional program to avoid an 
 aid reduction in any year, may adjust the annual school schedule 
 for that program throughout the calendar year.
