A Class I Previous railroad Next or Class II Previous railroad Next must not operate a train or light engine used in connection with the movement of freight unless it has a crew of a minimum of two individuals.
(a) For purposes of this subdivision, "shared corridor" means a segment of Previous railroad Next track in which light rail transit operates within or adjacent to right-of-way used in freight rail operation.
(b) A Class III Previous railroad Next while operating in a shared corridor must not operate a train or light engine used in connection with the movement of freight unless it has a crew of a minimum of two individuals.
The requirements of this section do not apply to hostler services or utility employees.
(a) Any Previous railroad that willfully violates this section must pay a fine of not less than $250 or more than $1,000 for a first offense, not less than $1,000 or more than $5,000 for a second offense committed within three years of the first offense, and not less than $5,000 nor more than $10,000 for a third or subsequent offense committed within three years of the first offense.
(b) Fines prescribed in this section must be recovered in a civil action before a judge of the county in which the violation occurs.
