A bill for an act
relating to health; providing a temporary permit to practice without compensation
to dentists or dental hygienists licensed in another state; amending Minnesota
Statutes 2010, section 150A.06, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2010, section 150A.06, is amended by adding a
subdivision to read:

new text begin Temporary permit to practice without compensation. new text end

new text begin (a) The board
may grant a temporary permit to practice in this state to a dentist or dental hygienist
licensed in another state who will provide care to Minnesotans in need of dental care and
do so on a voluntary basis without compensation. The board shall issue a temporary
permit if:

new text begin (1) the board determines that the applicant's services will provide dental care to
Minnesotans that may have barriers to obtaining dental care; and

new text begin (2) the applicant provides adequate proof of an active license to practice in another
state. The board may require such proof on an application form developed by the board
and may require a photocopy or electronic copy of the applicant's license.

new text begin (b) The permit to practice without compensation shall limit dental care services for a
period of time not to exceed ten days in a single year. The board may renew temporary
permits.

new text begin (c) The board may not assess a fee for a temporary permit nor require an applicant to
pass an examination of state statutes and rules relating to dentistry or dental hygiene.

new text begin (d) The holder of a temporary permit to practice without compensation is subject
to Minnesota state laws and rules regarding dentistry and the regulatory authority of the
board. The board may revoke a permit of a dentist or dental hygienist practicing under
this subdivision or take a regulatory action against the dentist or dental hygienist. If an
action is taken, the board shall report the action to the regulatory board of the dentist's
or dental hygienist's home state.
