An act

relating to commerce; modifying requirements for Department of Commerce licensee education;

amending Minnesota Statutes 2012, section 45.25, subdivisions 2a, 5a.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2012, section 45.25, subdivision 2a, is amended to read:

Subd. 2a.

Classroom course.

"Classroom course" means an educational process based on deleted text begin no geographical separation of instructor and learner deleted text end new text begin live or real-time instruction including, but not limited to: new text end

new text begin (1) a course in which there is no geographic separation of instructor and learner; new text end

new text begin (2) a course taught live that is concurrently simulcast to remote locations and where each location is monitored by a proctor; and new text end

new text begin (3) a course taught live that is concurrently simulcast to individual students online and that includes a process to authenticate the student's identity and technology to guarantee seat time new text end .

Sec. 2.

Minnesota Statutes 2012, section 45.25, subdivision 5a, is amended to read:

Subd. 5a.

Distance learning course.

"Distance learning course" means an education process new text begin , other than the courses specified in subdivision 2a, clauses (2) and (3), that is new text end based on the geographical separation of instructor and learner. This includes, but is not limited to:

(1) an interactive Internet course new text begin that does not meet the requirements of subdivision 2a, clauses (2) or (3) new text end ; and

(2) a new text begin noninteractive new text end course taught deleted text begin live deleted text end deleted text begin by the instructor deleted text end via the Internet, video, or other electronic means.
