An act

relating to police officers; permitting police officers to be represented by an attorney and a union representative at disciplinary hearing;

amending Minnesota Statutes 2006, section 626.89, subdivision 9.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 626.89, subdivision 9, is amended to read:

Subd. 9.

Presence of attorney deleted text begin ordeleted text end new text begin andnew text end union representative.

The officer whose formal statement is taken has the right to have deleted text begin an attorney ordeleted text end new text begin anew text end union representative deleted text begin of the officer's choosingdeleted text end new text begin or an attorney retained by the officer, or both,new text end present during the session. The officer may request the presence of deleted text begin andeleted text end new text begin thenew text end attorney or new text begin the new text end union representativenew text begin , or both,new text end at any time before or during the session. When a request under this subdivision is made, no formal statement may be taken until a reasonable opportunity is provided for the officer to obtain the presence of the attorney or new text begin the new text end union representative.
