                  An act relating to natural resources; adding to and 
                  deleting from state parks; providing for the 
                  administration of certain boathouse lot leases in 
                  Soudan underground mine state park; amending Minnesota 
                  Statutes 1998, section 85.012, subdivision 32a. 
        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
           Section 1.  Minnesota Statutes 1998, section 85.012, 
        subdivision 32a, is amended to read: 
           Subd. 32a.  Lac qui Parle state park, Lac qui Parle county 
        and Chippewa counties, which is hereby renamed from Lac qui 
        Parle state recreation area. 
           Sec. 2.  [ADDITIONS TO STATE PARKS.] 
           Subdivision 1.  [85.012] [Subd. 13.] [CHARLES A. LINDBERGH 
        STATE PARK, MORRISON COUNTY.] 
           The following area is added to Charles A. Lindbergh state 
        park, all in Township 129 North, Range 29 West, Morrison 
        county:  That part of Government Lots 1 and 2 of Section 5 
        described as follows:  Commencing at the northwest corner of 
        said Section 5; thence North 89 degrees 58 minutes 32 seconds 
        East 2416.82 feet (assumed bearing) along the north line of said 
        Section 5 to an iron monument in the center line of Morrison 
        county road No. 213, the point of beginning; thence South 36 
        degrees 16 minutes 09 seconds West 1479.77 feet along said 
        center line; thence South 24 degrees 14 minutes 08 seconds West 
        286.99 feet continuing along said center line; thence South 15 
        degrees 42 minutes 07 seconds West 80.60 feet, continuing along 
        said center line; thence North 89 degrees 58 minutes 32 seconds 
        East 1286.20 feet, more or less, to the shore of the Mississippi 
        river; thence northerly along said shore to its intersection 
        with the north line of said Section 5; thence westerly along 
        said north line to point of beginning. 
           Subd. 2.  [85.012] [Subd. 16.] [FLANDRAU STATE PARK, BROWN 
        COUNTY.] 
           The following area is added to Flandrau state park, all in 
        Brown county: 
           (1) the Southwest Quarter of the Northwest Quarter; Lot 2 
        of the Northwest Quarter of the Northwest Quarter; Lot 4 of the 
        Northeast Quarter of the Northwest Quarter; Lot 6 of the 
        Southeast Quarter of the Northwest Quarter; Sublot 1 of Lot C 
        and Sublot 3 of Lot D of the Northeast Quarter; and Sublot 1 of 
        Lot A of the West Half of the Northeast Quarter, Section 5, 
        Township 109 North, Range 30 West; 
           (2) Sublot B of Lot 5 of the Southwest Quarter and Sublot 3 
        of Lot 3 of the Southeast Quarter, Section 32, Township 110 
        North, Range 30 West; 
           (3) that part of Outlot 407, city of New Ulm, lying outside 
        of the existing statutory boundary; and 
           (4) balance of Outlot 412; balance of Outlot 409; balance 
        of Outlot 408; Outlot 411; also, any and all portions of vacated 
        Lookout Street adjoining said described parcels, city of New Ulm.
           Subd. 3.  [85.012] [Subd. 27.] [MYRE-BIG ISLAND STATE PARK, 
        FREEBORN COUNTY.] 
           The following area is added to Myre-Big Island state park, 
        all in Freeborn county: 
           (1) The Southeast Quarter of the Southeast Quarter and the 
        West Half of the Southeast Quarter of Section 11, Township 102 
        North, Range 21 West, excepting the following two parcels from 
        said West Half of the Southeast Quarter: 
           (i) commencing at the northeast corner of the Southeast 
        Quarter of said Section 11; thence South 89 degrees 55 minutes 
        48 seconds West a distance of 2572.93 feet, on an assumed 
        bearing, on the north line of said Southeast Quarter to the 
        point of beginning; thence South 89 degrees 55 minutes 48 
        seconds West a distance of 66.00 feet on the north line of said 
        Southeast Quarter to the northwest corner thereof; thence South 
        00 degree 21 minutes 31 seconds East a distance of 969.71 feet 
        on the west line of said Southeast Quarter to the point on the 
        north right-of-way line of the Soo Line railroad; thence North 
        83 degrees 20 minutes 35 seconds East a distance of 66.40 feet 
        on the north right-of-way line of the Soo Line railroad; thence 
        North 00 degrees 21 minutes 31 seconds West a distance of 962.10 
        feet to the point of beginning; and 
           (ii) commencing at the northeast corner of the Southeast 
        Quarter of said Section 11; thence South 89 degrees 55 minutes 
        48 seconds West a distance of 2638.93 feet, on an assumed 
        bearing, on the north line of said Southeast Quarter to the 
        northwest corner thereof; thence South 00 degrees 21 minutes 31 
        seconds East a distance of 1070.32 feet on the west line of said 
        Southeast Quarter to a point on the south right-of-way line of 
        the Soo Line railroad, said point being the point of beginning; 
        thence South 00 degrees 21 minutes 31 seconds East a distance of 
        751.93 feet on the west line of said Southeast Quarter; thence 
        North 86 degrees 32 minutes 19 seconds East a distance of 550.32 
        feet; thence North 00 degrees 21 minutes 31 seconds West a 
        distance of 470.94 feet to a point on the north line of the 
        Southwest Quarter of the Southeast Quarter of said Section 11; 
        thence North 89 degrees 50 minutes 34 seconds West a distance of 
        483.53 feet on the north line of said Southwest Quarter of the 
        Southeast Quarter; thence North 00 degrees 21 minutes 31 seconds 
        West a distance of 254.13 feet to a point on the south 
        right-of-way line of the Soo Line railroad; thence South 83 
        degrees 20 minutes 35 seconds West a distance of 66.40 feet on 
        the south right-of-way line of said Soo Line railroad to the 
        point of beginning; 
           (2) the Northeast Quarter of the Southwest Quarter and the 
        North Half of the Southwest Quarter of the Southwest Quarter of 
        Section 12, Township 102 North, Range 21 West; 
           (3) the Northwest Quarter of the Northwest Quarter of 
        Section 13, Township 102 North, Range 21 West, excepting 
        therefrom the East 330 feet; 
           (4) the Northwest Quarter of the Northeast Quarter and the 
        Northeast Quarter of the Northeast Quarter of Section 14, 
        Township 102 North, Range 21 West, less therefrom 10 acres in 
        the southeast corner thereof heretofore conveyed to Richard P. 
        and Eileen C. Stieler; 
           (5) Government Lots 3 and 4, the West 5 acres of the North 
        Half of the Northeast Quarter and the Southwest Quarter of the 
        Northeast Quarter of Section 19, Township 102 North, Range 20 
        West; and 
           (6) the Southeast Quarter of the Northeast Quarter, Section 
        19, Township 102 North, Range 20 West, excepting the following 
        parcel:  Beginning at a point on the east line of said Southeast 
        Quarter of the Northeast Quarter, which point is 859.0 feet 
        North of the southeast corner thereof; thence westerly 1071.95 
        feet on a line parallel to the north line of said quarter 
        quarter section; thence northerly 447.0 feet on a line parallel 
        to the east line of said quarter quarter section; thence 
        easterly 1071.95 feet to the east line of said quarter quarter 
        section; thence southerly 447.0 feet on the east line of said 
        quarter quarter section to the point of beginning. 
           Subd. 4.  [85.012] [Subd. 32a.] [LAC QUI PARLE STATE PARK, 
        LAC QUI PARLE AND CHIPPEWA COUNTIES.] 
           The following areas are added to Lac qui Parle state park, 
        all in Township 118 North, Range 42 West, Chippewa county: 
           (1) a tract of land described as follows:  Beginning at the 
        northeast corner of Section 14; thence South 1283 feet measured 
        along the east line of said Section 14; thence in a 
        northwesterly direction along the 945 contour of the Lac qui 
        Parle lake project as now surveyed across the Northeast Quarter 
        of the Northeast Quarter of said Section 14 a distance of 1385 
        feet to the place where said contour line intersects the north 
        line of said Section 14; thence East along the north line of 
        said section 507.2 feet to the point of beginning; 
           (2) a tract of land described as follows:  Beginning at a 
        point on the west line of Section 13 a distance of 560 feet 
        south of the northwest corner of said section where the westerly 
        right-of-way line of the highway as now located across said 
        section intersects the west line of said section; thence 
        southerly along the westerly right-of-way of highway 1255 feet 
        to the point where the 945 contour line of the Lac qui Parle 
        lake project intersects the westerly line of the highway; thence 
        northwesterly on a line which bears North 73 degrees 55 minutes 
        West a distance of 75 feet; thence along a line which bears 
        North 44 degrees 44 minutes West a distance of 578.2 feet to the 
        west line of said Section 13; thence North along the west line 
        of said section 723 feet to the point of beginning, EXCEPTING 
        THEREFROM HOWEVER THE FOLLOWING DESCRIBED TRACT OF LAND:  
        Beginning at a point 1212.8 feet South of the northwest corner 
        of said Section 13 (this point being on the west line of said 
        Section 13); thence to left 33 degrees 41 minutes a distance of 
        315.5 feet; thence left 13 degrees 14 minutes a distance of 
        145.8 feet; thence right 02 degrees 36 minutes a distance of 
        178.0 feet; thence left 29 degrees 19 minutes a distance of 63.0 
        feet; thence left 135 degrees 26 minutes a distance of 235.8 
        feet; thence right 12 degrees 04 minutes a distance of 240.0 
        feet; thence left 02 degrees 02 minutes a distance of 200.0 
        feet; thence left 99 degrees 08 minutes a distance of 247.6 feet 
        to point of beginning; and 
           (3) the Southeast Quarter of the Northeast Quarter of 
        Section 11. 
           Subd. 5.  [85.012] [Subd. 43.] [MINNEOPA STATE PARK, BLUE 
        EARTH COUNTY.] 
           The following area is added to Minneopa state park, all in 
        Section 20, Township 108 North, Range 27 West, Blue Earth county:
        That part of the East 390 feet of the Northeast Quarter of the 
        Northwest Quarter and the Northwest Quarter of the Northeast 
        Quarter except the East 660 feet and lying southerly of the 
        Union Pacific railroad right-of-way and lying northerly of 
        county state-aid highway No. 69. 
           Subd. 6.  [85.012] [Subd. 53.] [SIBLEY STATE PARK, 
        KANDIYOHI COUNTY.] 
           The following area is added to Sibley state park, Kandiyohi 
        county:  the South Half of the Northeast Quarter of Section 12, 
        Township 121 North, Range 35 West. 
           Sec. 3.  [DELETIONS FROM STATE PARKS.] 
           Subdivision 1.  [85.012] [Subd. 32a.] [LAC QUI PARLE STATE 
        PARK, LAC QUI PARLE AND CHIPPEWA COUNTIES.] 
           The following area is deleted from Lac qui Parle state 
        park, Chippewa county:  the Northwest Quarter of the Southwest 
        Quarter of Section 12, Township 118 North, Range 42 West. 
           Subd. 2.  [85.012] [Subd. 33.] [LAKE BEMIDJI STATE PARK, 
        BELTRAMI COUNTY.] 
           The following area is deleted from Lake Bemidji state park, 
        Beltrami county:  the Northwest Quarter of the Northwest Quarter 
        of Section 13, Township 147 North, Range 33 West. 
           Sec. 4.  [BOATHOUSE LEASES; SOUDAN UNDERGROUND MINE STATE 
        PARK.] 
           (a) Notwithstanding Minnesota Statutes, sections 85.011; 
        85.012, subdivision 1; and 86A.05, subdivision 2, the leased 
        boathouse lots located at Stuntz bay in the Soudan underground 
        mine state park are extended for the lifetime of the current 
        leaseholder.  The commissioner of natural resources shall not 
        cancel a lease, except for noncompliance with the lease 
        agreement. 
           (b) A lease, described under paragraph (a), may be 
        transferred only once by the current leaseholder to a person 
        within the third degree of kindred according to civil law or to 
        first cousins.  When possession is transferred, the transferee 
        shall notify the commissioner and pay to the department of 
        natural resources an annual lease fee.  The commissioner may 
        offer and, after agreement with the leaseholder, lease 
        equivalent alternative boathouse sites to a leaseholder. 
           (c) By January 15, 2001, the commissioner of natural 
        resources shall report to the senate and house environment and 
        natural resources policy and finance committees on boathouse 
        leases in state parks.  The report shall include information on: 
           (1) the number of boathouse leases; 
           (2) the number of leases that have forfeited; 
           (3) the expiration dates of the leases; 
           (4) the historical significance of the boathouses; 
           (5) recommendations on the inclusion of the land described 
        in paragraph (d) within the park boundary; and 
           (6) any other relevant information on the leases. 
           (d) The commissioner of natural resources shall contact 
        U.S.X. Corporation and local units of government regarding the 
        inclusion of the following lands within Soudan underground mine 
        state park: 
           (1) all lands located South of Vermillion Lake shoreline in 
        Section 13, Township 62 North, Range 15 West; 
           (2) all lands located South of Vermillion Lake shoreline in 
        the S1/2-SE1/4 of Section 14, Township 62 North, Range 15 West; 
           (3) NE1/4-SE1/4 and E1/2-NE1/4 of Section 22, Township 62 
        North, Range 15 West; 
           (4) all lands located South of Vermillion Lake shoreline in 
        Section 23, Township 62 North, Range 15 West; 
           (5) all of Section 24, Township 62 North, Range 15 West; 
           (6) all lands North of trunk highway No. 169 located in 
        Section 25, Township 62 North, Range 15 West; 
           (7) all lands North of trunk highway No. 169 located in 
        Section 26, Township 62 North, Range 15 West; 
           (8) NE1/4-SE1/4 and SE1/4-NE1/4 of Section 27, Township 62 
        North, Range 15 West; and 
           (9) NW1/4 of Section 19, Township 62 North, Range 14 West.
