                            CHAPTER 362-H.F.No. 3830 
                  An act relating to claims; providing for payment of 
                  certain claims against the state; authorizing 
                  reimbursement of certain costs and fees; appropriating 
                  money; proposing coding for new law in Minnesota 
                  Statutes, chapter 3. 
        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
           Section 1.  [DEPARTMENT OF AGRICULTURE.] 
           The department of agriculture shall pay $16,692.19 to 
        Minnesota Clean Fuels, Inc. of Dundas, Minnesota, as a full and 
        final payment of its claim for ethanol development payments 
        under Minnesota Statutes, section 41A.09, for the quarter ended 
        September 30, 1996. 
           Sec. 2.  [BUREAU OF CRIMINAL APPREHENSION.] 
           The bureau of criminal apprehension shall reimburse special 
        agent Raymond S. DiPrima $4,028.62 for legal expenses incurred 
        in performing official duties. 
           Sec. 3.  [DEPARTMENT OF CORRECTIONS.] 
           Subdivision 1.  [SENTENCING TO SERVICE AND COMMUNITY 
        SERVICE.] The amounts in this subdivision are appropriated from 
        the general fund to the commissioner of corrections for payment 
        under Minnesota Statutes, section 3.739, to service providers as 
        indicated in this section in full and final payment of claims 
        against the state for medical services provided to individuals 
        who were injured while performing community service or 
        sentencing to service work for correctional purposes.  These 
        appropriations are available until June 30, 1999. 
           (a) For claims under $500 each and other claims already 
        paid by the department ..... $5,298.86. 
           (b) For medical services provided to Keith Fimon, who 
        suffered injuries while performing sentencing to service work in 
        Hennepin county ..... $1,269.53. 
           (c) For medical services provided to Cheriy Kimbley, who 
        suffered injuries while performing sentencing to service work in 
        Crow Wing county ..... $2,161.44. 
           (d) For medical services provided to Wilbert Lewis, who 
        suffered chest pain while performing sentencing to service work 
        in Hennepin county ..... $3,850.55. 
           (e) For medical services provided to Clarence Sam, who 
        suffered injuries while performing sentencing to service work in 
        Crow Wing county ..... $1,378.61. 
           Subd. 2.  [INMATE INJURIES.] The amounts in this 
        subdivision are appropriated from the general fund to the 
        commissioner of corrections for payment under Minnesota 
        Statutes, section 3.738, to persons as indicated in this section 
        in full and final payment of their claims against the state for 
        injuries while performing assigned duties as inmates in 
        correctional facilities.  These appropriations are available 
        until June 30, 1999. 
           (a) For medical services provided to Richard Dahl, who 
        suffered injuries while incarcerated at MCF-Stillwater ..... 
        $1,128.87. 
           (b) To Aquinaldo Adkins, who suffered permanent injuries to 
        his left hand while incarcerated at MCF-Faribault ..... $10,800. 
           Subd. 3.  [MCF-MOOSE LAKE CONVERSION.] $20,000 is 
        appropriated from the general fund to the commissioner of 
        corrections for full and final payment to Robert and Patricia 
        Riegger, for their claim against the state for losses they 
        incurred in the conversion of the state hospital at Moose Lake 
        into a corrections facility.  This appropriation is available 
        until June 30, 1999. 
           Subd. 4.  [DAVID AND GAYLE JOHNSON.] $14,984.06 is 
        appropriated from the general fund to the commissioner of 
        corrections for full and final payment to David and Gayle 
        Johnson, for their claim against the state for funeral expenses 
        and other losses they incurred when their daughter, Melissa 
        Johnson, was murdered by an inmate conditionally released from 
        MCF-St. Cloud.  This appropriation is available until June 30, 
        1999. 
           Sec. 4.  [DEPARTMENT OF HUMAN SERVICES.] 
           $3,292.58 is appropriated from the general fund to the 
        commissioner of human services for payment under Minnesota 
        Statutes, section 256J.68, to persons who provided medical and 
        interpreter services to Chia Lor, who was injured while 
        performing community work experience in Ramsey county.  This 
        appropriation is available until June 30, 1999. 
           Sec. 5.  [DEPARTMENT OF LABOR AND INDUSTRY.] 
           $23,773.41 is appropriated from the general fund to the 
        commissioner of labor and industry for full and final payment to 
        Deputy Nancy Ann Wiggin of the Benton county sheriff's office 
        for financial losses she incurred in the performance of her 
        duties.  This appropriation is available until June 30, 1999. 
           Sec. 6.  [DEPARTMENT OF NATURAL RESOURCES.] 
           The department of natural resources shall pay $6,250 to the 
        town of Urness in Douglas county to be used to partially 
        reimburse Red Rock lake shore owners for their contributions in 
        1994 to the cost of construction of a culvert necessary to lower 
        the level of the lake. 
           Sec. 7.  [DEPARTMENT OF REVENUE.] 
           The department of revenue shall refund $19,854.07 to 
        Lakeside Medical Center, Inc., 129 E. 6th Avenue, Pine City, MN 
        55063, as a full and final payment of its claim for sales taxes 
        erroneously paid for the period January 1989 through February 
        1993. 
           Sec. 8.  [3.7365] [LEGAL COUNSEL; REIMBURSEMENT.] 
           If reimbursement is requested by the officer or employee, a 
        state department or agency may reimburse a state officer or 
        employee for any reasonable costs and reasonable attorney's fees 
        incurred by the person to defend charges of a criminal nature 
        brought against the person that arose out of the reasonable and 
        lawful performance of duties for the state. 
           Sec. 9.  [EFFECTIVE DATE.] 
           Sections 1 to 7 are effective the day following final 
        enactment.  Section 8 is effective the day following final 
        enactment for reimbursement of costs and fees incurred since 
        September 1, 1997.
