                  An act relating to claims against the state; providing 
                  for payment of various claims; appropriating money; 
                  amending Minnesota Statutes 1994, section 3.739, 
                  subdivisions 2 and 2a. 
        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
           Section 1.  [DEPARTMENT OF CORRECTIONS.] 
           The amounts in this section are appropriated from the 
        general fund to the commissioner of corrections for payment 
        under Minnesota Statutes, section 3.739, to service providers as 
        indicated in this section in full and final payment of claims 
        against the state for medical services provided to individuals 
        who were injured while performing community service or 
        sentencing to service work for correctional purposes.  These 
        appropriations are available until June 30, 1997. 
           (a) For claims under $500.00 each and other claims already 
        paid by the department.....$5,614.30. 
           (b) For medical services provided to Terry Grunwald, who 
        suffered injuries while performing community work service in 
        Todd county.....$652.16. 
           (c) For medical services provided to Mark Rogalski, who 
        suffered injuries while performing sentencing to service work in 
        Todd county.....$581.75. 
           (d) For medical services provided to Rhonda Snyder, who 
        suffered injuries while performing community work service in 
        Anoka county.....$272.00. 
           Sec. 2.  [DEPARTMENT OF HUMAN SERVICES.] 
           $96.36 is appropriated from the general fund to the 
        commissioner of human services for claims under Minnesota 
        Statutes, section 256.737, that have already been paid.  This 
        appropriation is available until June 30, 1997. 
           Sec. 3.  [DEPARTMENT OF NATURAL RESOURCES.] 
           The amounts in this section are appropriated from the 
        general fund to the commissioner of natural resources for 
        payment to the persons named in this section in full and final 
        payment of claims against the state for the reasons given.  
        These appropriations are available until June 30, 1997. 
           (a) Jack Gow, HCRA, Box 453, McGregor, MN 55760, for 
        expenses incurred in buying back land after a new survey by the 
        department.....$1,535.62. 
           (b) Bernard Schmalzbauer, 4648 Clark Avenue, White Bear 
        Lake, MN 55110, for expenses incurred because of erroneous 
        information provided by the department.....$4,000.00.  The 
        department shall pay an additional $4,000.00 to Mr. Schmalzbauer 
        from its existing appropriations. 
           Sec. 4.  [DEPARTMENT OF REVENUE.] 
           $4,180.40 is appropriated from the general fund to the 
        commissioner of revenue to pay a refund of use tax overpaid in 
        1989 and for which a refund claim was not filed until after the 
        statute of limitations had expired. 
           Sec. 5.  [DEPARTMENT OF TRANSPORTATION.] 
           The department of transportation shall pay $3,231.25 to Mr. 
        Joseph Hudak for legal expenses incurred in performance of his 
        duties as an employee of the department. 
           Sec. 6.  [DEPARTMENT OF VETERANS AFFAIRS.] 
           Subdivision 1.  [APPROPRIATION.] The amounts in this 
        section are appropriated from the general fund to the 
        commissioner of veterans affairs for payment to the persons 
        named in this section in full and final payment of claims 
        against the state for adjusted compensation arising from World 
        War I, World War II, the Korean Conflict, and Vietnam service.  
        These appropriations are available until June 30, 1997.

           Subd. 9.  [ADDITIONAL VALID CLAIMS.] The commissioner of 
        veterans affairs shall pay any other claims for adjusted 
        compensation that were filed with the department before January 
        1, 1996, if the commissioner determines that the claims are 
        valid.  The commissioner may seek reimbursement for any claims 
        paid under this subdivision from the joint subcommittee on 
        claims. 
           Sec. 7.  Minnesota Statutes 1994, section 3.739, 
        subdivision 2, is amended to read: 
           Subd. 2.  [EVALUATION AND PAYMENT OF CLAIMS.] Claims of 
        $500 or less subject to this section shall be investigated by 
        the state or local agency responsible for supervising the work 
        to determine if the claim is valid and if the loss is covered by 
        the claimant's insurance.  The investigating agency shall submit 
        all appropriate claims to the department of 
        corrections.  Subject to the limitations contained in 
        subdivision 2a, the department shall pay the portion of an 
        approved claim that is not covered by the claimant's insurance.  
        This payment shall be made within a reasonable time.  On or 
        before the first day of each legislative session, the department 
        shall submit to the appropriate committees of the senate and the 
        house of representatives a list of the claims paid by it during 
        the preceding calendar year and shall be reimbursed by 
        legislative appropriation for the claims paid.  For the purposes 
        of this paragraph, in the case of a juvenile claimant the term 
        "claimant's insurance" includes the insurance of the juvenile's 
        parents if the juvenile is covered by the insurance.  
           A claim in excess of $500, and a claim that was not paid by 
        the department may be presented to, heard, and determined by the 
        appropriate committees of the senate and the house of 
        representatives and, if approved, shall be paid pursuant to 
        legislative claims procedure.  
           No juvenile claimant receiving payment under this section 
        may be identified by name either in the list of claimants 
        submitted by the department or in the legislative appropriation. 
           Sec. 8.  Minnesota Statutes 1994, section 3.739, 
        subdivision 2a, is amended to read: 
           Subd. 2a.  [LIMITATIONS.] Compensation paid under this 
        section is limited to reimbursement for medical expenses and 
        compensation for permanent total or partial disability or 
        death.  Reimbursement for medical expenses under this section is 
        limited to the amount which would be payable for the same 
        expenses under the medical assistance program authorized under 
        chapter 256B.  No compensation shall be paid under this section 
        for pain and suffering.  Payments made under this section shall 
        be reduced by any proceeds received by the claimant or the 
        medical care provider from any insurance policy covering the 
        loss.  For the purposes of this section, "insurance policy" does 
        not include the medical assistance program authorized under 
        chapter 256B or the general assistance medical care program 
        authorized under chapter 256D. 
           Sec. 9.  [EFFECTIVE DATE.] 
           This act is effective the day following final enactment.
